<br />. <br /> <br />. <br /> <br />Cbi1W'\J....cl <br /> <br />COUNTY OF HAWAII <br /> <br />STATE OF HAWAII <br /> <br />RESOLUTION NO. 148 97 <br />(DRAFT 2) <br /> <br />A RESOLUTION REQUESTING THAT THE DEPARTMENT OF PUBLIC WORKS- <br />BUILDING DIVISION, THE PLANNING DEPARTMENT, THE OFFICE OF THE <br />CORPORATION COUNSEL AND THE LEGISLATIVE AUDITOR'S OFFICE CONDUCT A <br />REVIEW OF CHAPTER 3, RELATING TO ADVERTISING AND SIGNS, OF THE HA WAIl <br />COUNTY CODE. <br /> <br />WHEREAS, Chapter 3 of the Hawaii County Code, relating to Advertising and Signs, <br />was adopted in 1983; and <br /> <br />WHEREAS, since then, it has become evident that the sign requirements outlined in this <br />Chapter of the Hawaii County Code are unclear, confusing and ineffective in regulating the <br />construction and erection of signs within our County; and <br /> <br />WHEREAS, this ineffectiveness is highlighted at times when sign variances have come <br />before the Council for approval and raised questions as to the practical application of Chapter 3 <br />within our County; and <br /> <br />WHEREAS, the Corporation Counsel, in letters dated July 31, 1997 and May 23, 1996, <br />confirmed the ineffectiveness of this chapter by referring to Chapter 3 as unenforceable and <br />possibly unconstitutional. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY <br />HA WAIl that it recognizes the need to revise Chapter 3 of the Hawaii County Code, relating to <br />Advertising and Signs, for further clarification, effectiveness and enforcement; and <br /> <br />BE IT FURTHER RESOLVED that the Council requests that the Department of Public <br />Works-Building Division, the Planning Department, the Office of the Corporation C,ounsel and <br />the Legislative Auditor's Office assign a representative to serve on a task force charged with <br />conducting a review of Chapter 3, relating to Advertising and Signs. <br /> <br />BE IT FURTHER RESOLVED that this multi-agency task force develop a preliminary <br />draft bill which seeks to clarify and address at a minimum the following areas of concern: <br /> <br />1. Definitions <br />2. Sign permit and variance process <br />3. Enforcement of the sign code <br />4. Constitutionality of the sign code <br />5. Continuity between sign regulations set out <br />in Special Districts <br />
