<br />. . <br /> <br />. <br /> <br />. <br /> <br />:1 <br />I <br /> <br />, <br /> <br />COUNTY OF HAWAII <br /> <br />STATE OF HAWAII <br /> <br />RESOLUTION NO. <br /> <br />154 97 <br /> <br />RESOLUTION ACCEPTING APPROXIMATELY 1.51 ACRES (65,776 SQUARE <br />FEET) OF REAL PROPERTY AND ALL IMPROVEMENTS THEREON AT <br />KEAUHOU 1 AND 2, NORTH KONA, HAWAII (TMK: (3) 7-8-007:053). <br /> <br />WHEREAS, KAMEHAMEHA INVESTMENT CORPORATION ("KIC") is the owner <br />of approximately 1.51 acres (65,776 square feet) of real property located at Keauhou 1 <br />and 2, North Kona, Hawaii, identified as TMK: (3) 7-8-007:053 ("Property"); and <br /> <br />WHEREAS, the County of Hawaii ("County") originally had planned to construct <br />a fire station on real property located at Keauhou 1st, North Kona, Hawaii, identified as <br />TMK (3) 7-8-010:083 ("Original Property"); and <br /> <br />WHEREAS, KIC and the County have entered into an Agreement dated June 18, <br />1996, whereby: (a) KIC would construct a turn-key fire station on the Property for the <br />total sum of ONE MILLION TWO HUNDRED SEVENTY-FIVE THOUSAND and <br />NO/I00 DOLLARS ($1,275,000.00), and (b) the County would acquire the Property in <br />exchange for the Original Property; and <br /> <br />WHEREAS, on January 4, 1996, KIC was granted Special Permit No. 918 for the <br />construction and use of the Property for a fire station as an "unusual and reasonable" use <br />of land within the State Agricultural District pursuant to HRS Section 205-6; and <br /> <br />WHEREAS, the County has provided KIC with the agreed-upon monies for the <br />construction; and <br /> <br />WHEREAS, KIC has completed the construction of said fire station in a manner <br />satisfactory to the County; and <br /> <br />WHEREAS, the operation of said fire station by the County will provide improved <br />public safety and considerable savings on fire insurance premiums for residents in the <br />adjacent area; and <br /> <br />WHEREAS, the County Charter, under Article XIII, Section 13-12, provides that <br />the County Council ("Council"), on behalf of the County, may accept interests in real <br />property. <br />
