. . . . :1 I , COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 154 97 RESOLUTION ACCEPTING APPROXIMATELY 1.51 ACRES (65,776 SQUARE FEET) OF REAL PROPERTY AND ALL IMPROVEMENTS THEREON AT KEAUHOU 1 AND 2, NORTH KONA, HAWAII (TMK: (3) 7-8-007:053). WHEREAS, KAMEHAMEHA INVESTMENT CORPORATION ("KIC") is the owner of approximately 1.51 acres (65,776 square feet) of real property located at Keauhou 1 and 2, North Kona, Hawaii, identified as TMK: (3) 7-8-007:053 ("Property"); and WHEREAS, the County of Hawaii ("County") originally had planned to construct a fire station on real property located at Keauhou 1st, North Kona, Hawaii, identified as TMK (3) 7-8-010:083 ("Original Property"); and WHEREAS, KIC and the County have entered into an Agreement dated June 18, 1996, whereby: (a) KIC would construct a turn-key fire station on the Property for the total sum of ONE MILLION TWO HUNDRED SEVENTY-FIVE THOUSAND and NO/I00 DOLLARS ($1,275,000.00), and (b) the County would acquire the Property in exchange for the Original Property; and WHEREAS, on January 4, 1996, KIC was granted Special Permit No. 918 for the construction and use of the Property for a fire station as an "unusual and reasonable" use of land within the State Agricultural District pursuant to HRS Section 205-6; and WHEREAS, the County has provided KIC with the agreed-upon monies for the construction; and WHEREAS, KIC has completed the construction of said fire station in a manner satisfactory to the County; and WHEREAS, the operation of said fire station by the County will provide improved public safety and considerable savings on fire insurance premiums for residents in the adjacent area; and WHEREAS, the County Charter, under Article XIII, Section 13-12, provides that the County Council ("Council"), on behalf of the County, may accept interests in real property.
