HomeMy WebLinkAboutRES 054 Draft 01 2008-2010COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 54 09 RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT OF DEFENSE, STATE CIVIL DEFENSE, PURSUANT TO HRS 46-7, FOR SUPPORT OF THE COUNTY OF HAWAI`I'S MULTI-HAZARD MITIGATION PLAN UPDATE WHEREAS, an update of the County of Hawai`i's multi-hazard mitigation plan is required to be submitted to the Federal Emergency Management Agency (FEMA) by July 2010; and WHEREAS, the multi-hazard mitigation plan is in support of State and County commitments toward long term strategies to reduce the risks of natural hazards and will reduce further losses: and WHEREAS, the update to the multi-hazard mitigation plan is to include information from two (2) University of Hawaii projects: Lava flow modeling and Landslide area mapping, and one (1) County of Hawaii Department of Public Works' Comprehensive Floodplain Management program; and WHEREAS, the State of Hawaii, through the federal share, is providing the funding for all of these projects; and WHEREAS, the non-federal match will be provided in the form of in-kind contributions by the participating agencies; and WHEREAS, the Hawaii County Civil Defense Agency is designated as the pass- through agency, for all invoices related to the projects, to the State and will also maintain accountablility of all in-kind activities that contribute towards the non-federal share; and WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments obtain the consent of the council to enter into agreements with the federal or state governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers. O O NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with section 46-7, Hawaii Revised Statutes, that the Mayor of the County of Hawaii is authorized to execute, on behalf of the County, the Memorandum of Agreement with the State Civil Defense, attached hereto and incorporated herein by reference as Exhibit "A", for their support of the County of Hawai'i's Multi-Hazard Mitigation Plan Update. BE IT FURTHER RESOLVED that the Mayor of the County of Hawaii is authorized to sign the above-referenced agreement and any related documents on behalf of the Office of the Mayor and the County of Hawaii pursuant to the Hawaii County Charter. BE IT FURTHER RESOLVED that the County Clerk of the County of Hawaii shall transmit copies of this resolution to the Office of the Mayor, the Finance Department, the Hawaii County Civil Defense Agency, and the State of Hawaii Department of Defense. This MEMORANDUM OF AGREEMENT (MOA), entered into on this th day of 2009 by and between the Department of Defense, State of Hawaii, on behalf of its Civil Defense Division, hereinafter referred to as "STATE," and the County of Hawaii, on behalf of its Hawaii County Civil Defense Agency, hereinafter referred to as "COUNTY." 2. The purpose of this MOA is to support the project objective of and activities related to the project entitled "County of Hawaii Multi-Hazard Mitigation Plan Update". This project will result in a comprehensive update of the Hawaii County Multi-Hazard Mitigation Plan and will include information from the projects "Enhanced Interactive Lava Flow Modeling Program F1owGo II," "Mapping of Landslide Hazard Areas," and "Area Development Plan for Existing and Future Development." The update of the multi-hazard mitigation plan is in support of State and County commitments toward long-term strategies to reduce the risks of natural hazards and will reduce future losses. The scope of work as provided in the FEMA-approved application and further described in the project proposal by the COUNTY is attached. The formal name of the project is "County of Hawaii Multi-Hazard Mitigation Plan Update." 3. Period of Performance. This MOA covers the period beginning with January 26, 2009, and ending July 10, 2011. 4. Modifications. Any extensions, changes or alterations to the MOA shall be agreed to by both parties in writing before being undertaken and the same shall be evidenced by written amendment to this MOA. 5. Project Budget. The STATE through the federal share shall provide a maximum amount of $361,448 for this project. The Non-Federal share of $128,003 shall be provided in the form of in-kind contributions and/or cash match which represent 25 percent of total project costs. The COUNTY shall maintain accountability of all in-kind activities that contribute to the 25% non- federal share. All projects shall be associated with the categories of activities cited in paragraph 2. The project proposal, including approved budget and cost-share are further described in the attached project application. EXHIBIT "A" 6. Subcontracts. [f the COUNTY subcontracts any or all of the work required under this Agreement, the COUNTY agrees to include in the subcontract that the subcontractor is bound by the same terms and conditions of this Agreement with the STATE. A copy of the executed subcontract must be forwarded to the STATE within ten (10) days of the execution of said contract. Contractual agreement shall in no way relieve the Recipient of its responsibilities to ensure that all funds issued pursuant to this grant be administered in accordance with all sate an federal requirements. 7. Method of Payment. Payments shall be made on a reimbursable basis. If other payment arrangements for costs incurred as a result of this MOA are desired, agreement must be reached after consultation between the fiscal offices of the STATE and COUNTY. 8. Quarterly Reports. The COUNTY is required to submit to the STATE a quarterly financial and performance report. Reports dates are March 31, June 30, September 30, and December 3 ] of each year. The first report is due on March 31, 2009. 9. Termination. Either party to this MOA shall have the privilege, with or without cause, to terminate this MOA at any time upon written notice given thirty (30) days in advance of such termination. Upon termination, the total amount to be paid to the COUNTY shall be determined on the basis of total work completed up to the date of such termination. The total land area of the county is 13,175 square kilometers, and comprises only the island of Hawaii. Census data from 2000 identifies a population of 148,677, and the 2006 estimate predicts an increase by 15.1%. Comments Geographically isolated from the nearest large land mass by at least 2400 miles, Hawaii County is largely required to be self-reliant in the event of large disasters, as proven by the Kiholo Bay earthquake of 2006, the floods of 2000, and the ongoing Kilauea volcano lava flow, which has consumed to date over 100 homes, destructively eliminated the community of Kalapana, has consumed over 65% of Royal Gardens subdivision and has added more than 540 acres to the County. The residents of Hawaii are immediately threatened by an interruption of necessary and life-dependent supplies should shipping or air entry be interrupted by disaster, and therefore the need to operate independent of inter-island and inter-continental dependence on delivery of emergency and life saving supplies is critical to the survival of the people of Hawaii. Mitigation Activity Information What type of activity are you proposing? 91.1 -Local Multihazard Mitigation Plan Please select one of the following options to describe the intent of this proposal: Update an existing plan I1elp If updating an existing Disaster Mitigation Act of 2000 plan, or modifying a plan adopted prior to the Disaster Mitigation Act of 2000, please explain. The purpose of the Hawaii County Plan Update is to update County multi-hazard mitigation information and also support the State's mitigation plan. The Plan update will include project data from the following county-level projects: 1) Enhanced Interactive Lava Flow Modeling Program F1owGo II, 2) Mapping of Landslide Hazard Areas, and 3) Area Development Plan for Existing and Future Development. 1) Enhanced Interactive Lava Flow Modeling Program F1owGo II: Will update information to identify at-risk areas, and support the Lava Flow Mitigation Plan, subsumed by reference by the State Multi-Hazard Mitigation Plan. The proposed study will provide updated information to identifying at-risk areas as a lava flow progresses, and assist in locating highest hazard areas as flows approach. At this time, the Kilauea Volcano lava flow is encroaching upon the Royal Gardens subdivision on Hawaii island, and has been repeatedly beset by lava flows since 1983, when the first home to be claimed by lava was first burned by and then overrun by the encroaching and devastating lava flow from the volcano that continues to erupt today. 2)Mapping of Landslide Hazard Areas: The data products from this project will enable improved earthquake loss estimates and analysis in support of the State Multi- Hazard Mitigation Plan and the Hawaii County MultiHazard Mitigation Plan. The emphasis of this study is on potential hazards impacting structures and lifelines, where seismically induced slope instability is significant. The data collected from this study will be used to generate potential hazard maps which could be used to identify already developed as well as future building or development zones that may warrant further detailed evaluation during planning. GIS maps are also planned, which could be used for prioritization of evaluative studies, as well as be used as assessment aids for earthquake damage emergency preparedness. 3) Area Development Plan for Existing and Future Development: This project proposes to refine regulations and policies for new developments, promote community education of precautions and protect existing developments, and provide community outreach in regard to individual protective measures. The Context Sensitive Solutions methodology will be used to identify a comprehensive programmatic approach to mitigate the risks to existing and future development in floodplain areas and to ~spdate and integrate floodplain regulations and laws. To reduce risk and minimize flood damage for existing developments, the study also . proposes to identify and prioritize floodplain mapping for all county districts for flood insurance, to develop policies for unprotected subdivisions, and to coordinate disaster preparedness planning relative to flood events and repetitive loss. Also known as the Big Island, Hawaii (County of Hawaii) is also the youngest island in the eight-island chain and was formed by five volcanoes, two of which are still active -Mauna Loa and Kilauea. Kilauea volcano poses a threat today, and at least one flow from the volcano poses a threat to an existing residential subdivision. The County is also home to the world's tallest mountain when measured from ocean floor to mountain peak, and as the southernmost island has the dubious claim of being the first in line to take a hit from tsunami and hurricane hazards that generate from the east and south, as well as subject to seismic hazard due to the ongoing eruptions of its active volcanoes. Known for its mountain of Mauna Kea, home to several mountain-top telescope observatories including the Keck Telescope, the County is also subject to extreme freezing conditions that precipitate snowfall and iced road conditions. The inclusion of the information from the analyses performed will support many of the Goals and Objectives of the state mitigation plan which are assumed by the County plan, and include the improvement of lifelines, infrastructure, critical facilities and reduce their vulnerability to hazazds, the improvement of building codes and buidding inventories and assessments, ensuring knowledge and accessibility of response plans and evacuation routes, encourage appropriate coastal-dependent development that reduces risks from coastal hazards at all stages of development, develop risk and vulnerability assessments, allow for an evaluation and update of the plan and promote proactive use of the plan. On completion of each study supported by the grant, the data and information gathered will be reviewed by an assigned committee, which will be tasked with assessing the information to identify appropriate mitigation measures, best-practices, retrofit schemes, and reduce hazard risks, as well as will reflect changes in the development and progress in countywide and statewide mitigation efforts and updates in priorities. Before final submittal, the Plan must be approved by the County Council and the County Mayor, and will have been subject to intermediary review prior to approval. An updated County Plan is required in order to qualify for future disaster-related grant funding, and the current plan expires June 29, 2010. Describe the strategy for completing this planning activity, including the review process, adoption, and FEMA's approval. The strategy to complete this study will initiate with the planning process, which will include consideration of mitigative actions and priorities that are identified as cost-effective, environmentally sound, and technically feasible, and will engage the resources of the local reseazch community, and will rely on the inclusion of scientific results of at least 5 projects that will run concurrent with the performance period of the plan update. The plan update will be comprehensive in scope and the coordinator of the update will be Hawaii Civil Defense Agency. Significant project contribution to the plan update (Project 1, Priority 1) will include the results from the Enhanced Interactive Lava Flow Modeling Program FLowGoII project, POC Dr. Donald Thomas-University of Hawaii; Mapping of Landslide Hazard Areas, POC Dr. Ian Robertson-University of Hawaii; Area Development Plan for Existing and Future Development, POC Mr. Jiro Sumada -Dept. of Public Works. The inclusion of the information from the analyses performed will support many of the Goals and Objectives of the state mitigation plan which are assumed by the County plan, and include the improvement of lifelines, infrastructure, critical facilities and reduce their vulnerability to hazazds, the improvement of building codes and buidling inventories and assessments, ensuring knowledge and accessibility of response plans and evacuation routes, encourage appropriate coastal-dependent development that reduces risks from coastal hazards at all stages of development, develop risk and vulnerability assessments, allow for an evaluation and update of the plan and promote proactive use of the plan. On completion of each study supported by the grant, the data and information gathered will be reviewed by an assigned committee, which will be tasked with assessing the information to identify appropriate mitigation measures, best-practices, retrofit schemes, and reduce hazard risks, as well as will reflect changes in the development and progress in countywide and statewide mitigation efforts and updates in priorities. Plan drafts and updates will be periodically sent to FEMA for draft review and input, followed by submittal of the final document to FEMA. Adoption of the updated plan reliant on acceptance, approval and order by the County Mayor to adopt, which will then be submitted to FEMA for final approval. Describe how you will manage the costs and schedule, and how you will ensure successful performance. The costs and schedule will be managed through the Project Manager/Point of Contact assigned by Hawaii County Civil Defense, and will be monitored through the requirement of regular quarterly progress reports. Describe the staff and resources needed to implement this mitigation activity and the applicant's ability to provide these resources. The comprehensive, all-hazards review update of the County of Hawaii Mitigation.plan will require a Project Manager to ensure overall coordination of the project, GIS analysts (includes spatial), an Engineer, a Planning Team, a Steering Committee to include qualified engineers, local meeting places for review and community input, county staff members to review the plan. If applying for multiple mitigation activities, how do these activities relate? The Plan update proposed for the Hawaii County will be comprehensive and include a full review of all-hazards from acounty-wide mitigation standpoint. Data will include and not be limited to the 3 specialized projects included in this application. The County acknowledges that the federal share requested for this plan update is an amount atypical of most county-level plan updates. The decision to include the 3 specialized mitigation projects referenced and included herein follows a thorough process of review and evaluation by the State Hazard Mitigation Forum -the primary planning mechanism for hazard mitigation planning in the State of Hawaii -and-final review and ranking were conducted by the Vice Director and Director of Civil Defense. The projects proposed each separately support the county mitigation strategy, and were evaluated against a scale that factors in degree to which a significant problem is resolved, if the solution is long-range, is environmentally sound, cost-effective, and of a high priority to the county. As stand-alone projects, each project included ranked high in all categories. The projects included in this application have been priority ranked by the representatives identified, and were selected for inclusion from a list of 20 proposed projects. The 4 projects included in this Plan update application retain their ranked order of priority, 1 being of the highest priority and 3 being of the lowest priority of the 4 included. The cost of each project has also been provided (and also in Section 9, Cost Estimate). Additional project informafion is also included in Section 6, Mitigation Activity Information, and Section 8, Scope of Work. 1)County of Hawaii Multi-Hazard Mitigation Plan Update: The current plan will expire June 29, 2005, and identifies and prioritizes the mitigation priorities for the County of Hawaii. Comprehensive in scope as a document which addresses all hazards to which the County is subject, the natural hazards addressed include tsunami, earthquake, hurricane, severe rain and wind storms, subsidence and landslides/mudslides, wildfire, and lava flow incursion. 2)Enhanced Interactive Lava Flow Modeling Program FlowGo II: Will update information to identify at-risk areas, and support the Lava Flow Mitigation Plan, and is subsumed by reference by the State Multi-Hazard Mitigation Plan. Fed Share: $65,588. 3)Mapping of Landslide Hazard Areas: The data products from this project will enable improved earthquake loss estimates and analysis in support of the State MHMP. The County of Hawaii mitigation plan update will leverage the involvement of its federal, state, community and district partners, to include and not limited to Hawaii Volcano Observatory, West Hawaii Wildfire Management Organization, Department of Forestry and Wildlife, NOAA, the University of Hawaii, and the Department of Land and Natural Resources through solicited input and feedback, collaborative review of mitigation commitments and review of ongoing agency-based mitigative efforts. The all-hazard mitigation update of the County Plan will require input for the many hazards which threaten the County and for which mitigative preparedness are essential. The agencies and partners that can provide current and updated information to assist in county mitigation efforts with regard to wildfire, tsunami, landslide, seismic-induced inundation, windstorm, flood, hurricane, earthquake, volcanic events, drought, land subsidence, and coastal storms.
