Yuen <br /> Planning Director <br /> Planning Department <br /> 101 Pauahi Street, Suite 3 <br /> Hilo, Hawaii 96720 <br /> <br /> Re: Request for Time Extension <br /> Ordinance No. 06-137 and Ordinance No. 06-138 <br /> Condition C - Deadline for Final Plan Approval and Completion of Construction <br /> Applicant: Samson LLC <br /> TMK No. (3) 7-5-010:013 (formerly TMK: (3) 7-5-023:063, 064 and 067) <br /> <br /> Dear Mr. Yuen: <br /> <br /> On behalf of our client, Samson LLC, we hereby request a time extension for <br /> Condition C of both Change of Zone Ordinance Nos. 06-137 and 06-138, to allow for additional <br /> time to secure Final Plan Approval, in addition to completing construction of the proposed one <br /> hundred forty-nine (149) multiple family residential units on the subject property. <br /> <br /> On November 8, 2006, the County Council approved both Ordinance No. 06-137 <br /> and Ordinance No. 06-138, which reclassified the separate areas of the subject property to <br /> Multiple-Family Residential-2,500 square feet (RM-2.5) and Village Commercial-7,500 square <br /> feet (CV-7.5). <br /> Condition C for both Ordinances provides that: <br /> <br /> Construction of the proposed development shall be completed within five (5) <br /> years from the effective date of this amendment. Prior to construction, the <br /> applicant, successors or assigns shall secure Final Plan Approval for the amended <br /> proposed development from the Planning Director in accordance with Section 25- <br /> 2-70, Chapter 25 (Zoning Code), Hawaii County Code within two (2) years from <br /> the effective date of this amendment. Plans shall identify all existing and/or <br /> proposed structures, paved driveway access and parking stalls associated with the <br /> proposed development.
