No. 463Bi11 No. 130 <br /> <br /> PLACE: Councilroom <br /> TIME: 10:30 A.M. <br /> Chair and Members <br /> <br /> Hawaii County Council <br /> <br /> Hilo, Hawaii 96720 <br /> Your Committee on Finance, to which was referred Bill No. 130, reports as follows: <br /> Bill No. 130, transmitted by Council Chair James Y. Arakaki, via Communication No. 463, dated <br /> August 26, 1997, initiates a Charter amendment of the Hawaii County Charter (1991 Edition), as <br /> amended, Article III, Section 3-4, relating to the Legislative Branch-County Council. <br /> Currently, members of the Council are elected to serve for a period of two years as adopted by the <br /> electorate in 1980. Since that time, not all Charter sections have been properly amended to reflect <br /> this adjustment from four to two year terms. Therefore, the following section of the Charter relating <br /> to a special election is moot. <br /> Article 3, Section 3-4 of the Hawaii County Charter, relating to Council vacancies states, "If the <br /> vacancy occurs more than two years before the end of the term, and sixty days or more before the <br /> next regulazly scheduled primary election, the council shall, through itsclerk, immediately issue a <br /> proclamation announcing that candidates shall be nominated to fill the unexpired term of the office <br /> at a special primary election to beheld..." <br /> Bill No. 130 proposes to correct present inconsistencies in the event of a vacancy within the County <br /> Council. <br /> Pursuant to Article XV, Section 15-1 of the Hawaii County Charter, amendments or revisions of the <br /> Charter may be initiated by ordinance of the council adopted after three readings on sepazate days. <br /> Upon adoption of the ordinance the council shall provide that the proposed amendments or <br /> revisions be submitted to the electors of the county for approval at the next general election. <br /> Your Committee on Finance is in accord with the purpose and intent of Bill No. 130 and <br /> recommends it pass first reading. <br /> Ikc <br /> Ayes N~e• A&e ~ Respectfully submitted <br /> CHUNG X <br /> LEITxEnn-TOnn x CO TT ON FINANCE <br /> RAY X <br /> SANTANGELO X <br /> SMITH X <br /> TYLER X AARON S.Y.
