<br />. <br /> <br />. <br /> <br />e:--"""" <br /> <br />COUNTY OF HAWAII <br /> <br />STATE OF HAWAII <br /> <br />RESOLUTION NO. 208__ 98 <br /> <br />A RESOLUTION AUTHORIZING AN AGREEMENT BETWEEN THE DEPARTMENT OF <br />EDUCATION AND THE COUNTY OF HAWAII TO DEVELOP A PLAYGROUND <br />FACILITY AT HONAUNAU SCHOOL. <br /> <br />WHEREAS, the County recognizes the need to develop a playground facility in the <br />Honaunau area of Kona; and <br /> <br />WHEREAS, the County has received the approval from the State of Hawaii, Department <br />of Education (DOE), to develop such a playground facility at Honaunau School, North Kona; and <br /> <br />WHEREAS, Kona architect, Jack Parazette is donating his services in designing and <br />drafting the structure; and <br /> <br />WHEREAS, the playground facility will be built to comply with the public playground <br />guidelines; and <br /> <br />WHEREAS, upon its completion, the playground facility shall be maintained by the <br />DOE, and the County will assume no responsibility in operating or maintaining the facility after <br />its completion; and <br /> <br />WHEREAS, the playground facility will be available to the public during non-school <br />hours; and <br /> <br />WHEREAS, Section 2-53, Hawaii County Code, provides that the County may use <br />public school property by agreement with the DOE to the extent that such property may be <br />adaptable and available for County recreational use. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF <br />HA WAIl that it authorizes the County Parks and Recreation Department to execute an agreement <br />with the Department of Education to develop a playground facility at Honaunau School. <br /> <br />BE IT FURTHER RESOLVED that upon its completion, the playground facility shall be <br />solely operated and maintained by the Department of Education, Honaunau School. <br />
