No. 111/Res. 48-09 <br />Your Committee on Public Works and Intergovernmental Relations, to which was referred <br />Communication No. 111, regarding Resolution 48-09, reports as follows: <br />Resolution 48-09, transmitted by Assistant Corporation Counsel Gerald Takase via <br />Communication No. 111, dated December 17, 2008, accepting the donation of Lot 13-C, situate at <br />Kaiwiki 3`d, Distirct of South Hilo, County and State of Hawaii, being a Portion of Tax Map <br />Key: (3)2-9-004-028 consisting of 0.018 acres, from Charles P. Cavedoni and Rong Hua. <br />There was no testimony from members of the public regarding the proposed resolution. <br />Committee Chair Brenda J. Ford relinquished her seat to Councilmember Dominic Yagong. Vice Chair <br />Kelly Greenwell was absent and excused for this meeting. <br />Article XIII, § 13-12 of the Hawaii County Charter provides that the Council may accept gifts, which <br />include the dedication of land, on behalf of the County of Hawaii. <br />Cavedoni and Hua are desirous of dedicating Lot 13-C to be made part of the public right-of--way. <br />Assistant Corporation Counsel Gerald Takase appeared before your Committee. Mr. Takase stated the <br />physical location of the roadway encroaches into the Cavedoni and Hua property. Pursuant to final <br />subdivision approval for Lot 13, the owners wished to donate the encroachment (Lot 13-C) to the <br />County of Hawaii. <br />Councilmember Dominic Yagong urged the support of his colleagues on this proposed resolution. <br />PWIRC RPT NO. 13 <br />
