No. 107/Bill No. 23 <br /> <br />Council Chair and Members <br />Hawai'i County Council <br />Hilo, Hawai'i 96720 <br /> <br />Your Committee on Finance, to which was referred Bill No. 23, reports as follows: <br /> <br />Bill No. 23, transmitted by Deputy County Clerk Rodney Oshiro, via Communication No.1 07, dated <br />January 21, 2009, amends Chapter 19, Article 11, Sections 19-90, 19-75, and 19-89.5, Hawai'i County <br />Code 1983 (2005 Edition, as amended), Relating to Real Property Tax - Determination of Rates. The <br />amendments are as follows: <br /> <br />1. Paragraph 19-90(b)( 1) requires notification in two newspapers of general circulation rather than one <br />and also deletes the 10 day minimum notice of the RPTR public hearing. <br />2. Paragraph 19-90(b )(2), which requires the council to re-advertise and reconvene within three weeks of <br />the public hearing is deleted in its entirety. Paragraph 19-90(b)(2) is replaced with those provisions <br />currently found in subsection 19-90( c). <br />3. Paragraph 19-90(b )(3), which requires compliance of paragraph 19-90(b)( 1) and (2) should the <br />Council require further increase or decrease of the RPTR is deleted in its entirety. This text is replaced <br />with the requirement that new tax rates shall be noticed in two newspapers of general circulation. <br />4. Subsection 19-90(c), which discloses the method to set the RPTR is deleted in its entirety. This <br />determination is now reflected above in number 2, paragraph 19-90(b )(2). <br />5. Paragraph 19-90(f), which disclosed the validity, directory and mandatory concerns is deleted in its <br />entirety. <br />6. Amend sections 19-75(b) and 19-89.5 so that current references to section 19-90(g) remain linked to <br />the renumbered section 19-90(e). <br /> <br />Council member Ford questioned Deputy County Clerk Rodney Oshiro as to whether or not this <br />amenciment would eliminate the need for a public hearing. Mr. Oshiro explained that it would not. <br /> <br />Councilmember Ford expressed concern that the Council does not get a proposed tax rate from the mayor <br />sooner in the process. She stated she felt this was putting the Council in the position of having to make <br />decisions in the dark. <br /> <br />FC Report: 26 <br />
