No. 128/Res. 52-U9 <br />Your Committee on Public Works and Intergovernmental Relations, to which was referred <br />Communication No. 128, regarding Resolution 52-09, reports as follows: <br />Resolution 52-09, transmitted by Assistant Corporation Counsel Gerald Takase via <br />Communication No. 128, dated February 4, 2009, authorizing the acquisition of private property by <br />eminent domain, being a portion of Tax Map Key: (3)] -7-031:010, situate at Kea`au, in the District of <br />Puna, County and State of Hawaii, for access to Happy Homes, from Cecelia Mae Chun and <br />William H. Hosnneyer. <br />The purpose of Resolution No. 52-09 is to authorize the County, pursuant to Section 101-13 of the <br />IIawai`i Revised Statutes, which requires Chat condemnation action by the County must be authorized by <br />a resolution of the County Council. <br />"Chere was no testimony from members of the public regarding the proposed resolution. <br />Assistant Corporation Counsel Gerald Takase appeared before your Committee. Mr. Takase commented <br />that this proposed resolution authorizes the acquisition of private property by eminent domain for the <br />roadway improvement fo Momona Road and I-sappy I-Iomes Access Road. <br />Councilmember J Yoshnnoto commented that a previous resolution was adopted by the Council <br />agreeing to road improvements for this community. Furthermore, Mr. Yoshimoto stated this project has <br />been on-going for over 10 years and would like to commend Mr. Takase for his assistance in this matter. <br />He seeks the support of his colleagues on this proposed resolution. <br />Council Chair Brenda J. Ford questioned the value of this property and amount that will be paid to <br />owners. Mr. Takase responded the minimum value of this property is assigned at zero (0). <br />PWIRC RPT NO. 16 <br />
