<br /> <br /> <br /> <br /> <br /> <br /> The Honorable J Yoshimoto, Chairman <br /> and Members of the County Council <br /> Page 4 <br /> <br /> Additionally, the existing mauka driveway on Olowalu Street, which the applicant <br /> had planned to use as the primary access to the site, is located less than 75 feet from the <br /> Kamanu Street intersection, and does not conform to Chapter 22, Hawaii County Code. <br /> To remedy this situation, DPW is recommending left-turn movements to and from this <br /> driveway be.prevented by the applicant either closing the driveway or installing a median <br /> barrier within Olowalu Street. The Planning Department advises against this <br /> recommendation because Chapter 22, Hawaii County Code was revised after the <br /> applicant constructed the driveway, so although the driveway is non-conforming now, at <br /> the time it was constructed it met the requirements of Chapter 22, Hawaii County Code. <br /> This driveway serves as the primary access to the development and therefore it would be <br /> unreasonably expensive to require the applicant to close off the driveway and re-design a <br /> different primary access for the development. <br /> <br /> The Department of Public Works is also recommending that the applicant provide <br /> sight distance easements along Olowalu Street and Kamanu Street. This recommendation <br /> will be included as a condition of the change of zone. <br /> <br /> The Kealakehe Police Station is located approximately two miles from the subject <br /> property, and fire protection is provided by the Kailua-Kona Fire Station located less than <br /> <br /> five miles from the property. The Kona Medical Center is located in Kealakekua, <br /> approximately ten miles from the property. <br /> <br /> Essential services and infrastructure, which include electricity, sewer, water, and <br /> roads, are available to the area. Thus, the granting of this change of zone would not <br /> unreasonably burden public agencies to provide roads and streets, sewer, water, drainage <br /> improvements and police and fire protection to accommodate the development of this <br /> property. <br /> <br /> The request is not contrary to Chapter 205A, Hawaii Revised Statues, relating to <br /> Coastal Zone Management Area. The subject property is located mauka of the Queen <br /> Ka`ahumanu Highway approximately two miles from the shoreline and is not in the <br /> Special Management Area. Thus, the property will not be affected by coastal hazards and <br /> beach erosion. There are no identified recreational resources, public access to the <br /> shoreline or mountain areas, scenic and open space preserves, coastal ecosystems, marine <br /> resources or other natural and environmental resources on the subject property. In a letter <br /> dated November 3, 2008, the State Department of Land and Natural Resources Historic <br /> Preservation Division (SHPD) stated that "no historic properties will be affected by this <br /> undertaking because development/urbanization and previous grubbing/grading has altered <br /> the land, and SHPD previously reviewed this project area and no mitigation was needed <br /> at that time." A condition of the change of zone will require that the applicant cease work <br /> and notify the Planning Department should any unanticipated archaeological features or <br /> sites be uncovered during the course of development. <br />
