COUNTY OF HAWAII <br />RESOLUTION NO. <br />STATE OF HAWAII <br />62 ®9 <br />(DRAF'P 2) <br />RESOLUTION AUTHORIZING THE ABANDONMENT, SALE AND ACQUISITION OF <br />REAL PROPERTY WITH RANDOLPH AND SUSAN CABRAL, TAX MAP <br />KEY: (3)2-6-010:060, SITUATE AT KAIWIKI, SOUTH HILO, HAWAII. <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. <br />WHEREAS, Kaiwiki Road, which is owned and maintained by the County of Hawaii, <br />encroaches on the southern portion of property owned by Randolph and Susan Cabral, identified <br />as Tax Map Key: (3)2-6-010:060, situate at Kaiwiki, in the District of South Hilo, Island, County <br />and State of Hawaii; and <br />WHEREAS, the County of Hawaii is the owner of aright-of--way designated as Road <br />Remnant "A," (outlined in green on the attached map), containing an area of 2,488 square feet, <br />that is not in use; and <br />WHEREAS, to correct this encroachment, Randolph and Susan Cabral wish to purchase <br />Road Remnant "A" from the County of Hawaii; <br />WHEREAS, Randolph and Susan Cabral also agree to sell to the County that portion of <br />their property (outlined in pink on the attached map), containing an area of 3,369 square feet; and <br />WHEREAS, the abandonment, sale and acquisition is advantageous to the County of <br />Hawaii in that it is the current alignment of the paved roadway; and <br />WHEREAS, Pamela Brand and the Stanton C. Oshiro Trust, as co-owners of Kaiwiki <br />Estates, the owner of Tax Map Key: (3)2-6-010-011, the adjoining parcel to Road Lot "A," have <br />relinquished any interest in purchasing Road Remnant "A"; and <br />WHEREAS, Sections 2-1 l land 2-118, Hawaii County Code, allows for the disposal of <br />remnant parcels. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF <br />HAWAII that the right-of--way designated as Road Remnant "A" outlined in green on the <br />attached map is hereby abandoned and discontinued as a County road. <br />BE IT FURTHER RESOLVED that in accordance with Sections 2-111 and 2-118, <br />Hawaii County Code, the Director of Finance is authorized to sell to Randolph and Susan <br />
