work and services performed by its agents and employees. <br />Furthermore, Grantee intentionally, voluntarily, and knowingly <br />assumes the sole and entire liability if such liability is <br />determined to exist, to its agents and employees or to third <br />persons, for all loss, cost, damage or injury caused by <br />Grantee's agents and employees in the course of their <br />employment. The performance of work under this Contract alone <br />shall not be construed as employment with the State of Hawaii <br />and shall not entitle Grantee's agents and employees to <br />vacation, sick leave, retirement, or other benefits directly <br />afforded state employees by statutes. Grantee shall be <br />responsible for payment of all applicable federal, state, and I <br />county fees which may become due and owing by the Grantee by <br />reason of the Contract, including but not limited to (i) income <br />taxes, (ii) employment related fees, assessments and taxes and <br />(iii) general excise taxes. The Grantee also is responsible <br />for obtaining all licenses, permits and certificates that may <br />be required in order to perform this Contract. <br />2.
