As was testified earlier the work of the State Supreme Court
is in progress and the work of the IRMP is inadequate.

Please defer decision making until the works are
completed.

If the Committee does not recommend to or the Council

does not defer decision making, I recommend reconfiguring
this application so that the 1800 `a'a flow, in its entirety,
remains as physically unencumbered as possible. Further,
I recommend that future applications be configured

consistant with this.

If an approved application must include compromising the
values expressed in the Natural Beauty section of the
County of Hawai'i General Plan (page 32) and exemplified

by Ka'upulehu (General Plan, page 36), then I agree with
the suggestion of an approximately 1000 foot set back
along the flow front.

Thank you for this opportunity to submit additional
testimony on this matter. Also please find a copy of the
transcript of my November 7, 1998 testimony before the
County of Hawai'i Planning Commission Contested Case

Hearings Officers attached.

And, while I did recommend in my November 13 testimony
that the Council review the transcript of Kepa Maly's
November 7, 1998 testimony, it is not yet available from the

Planning Department.

Thank you again for your consideration.
