COUNTY OF HAWAII <br />STATE OF HAWAII <br />RESOLUTION NO. 109 09 <br />A RESOLUTION AUTHORIZING THE EXTENSION OF THE PUBLIC SEWER FROM <br />PARCEL 2-4-001:005 TO THE INTERSECTION OF KILAUEAXAWILI STREET FOR <br />THE STATE OF HAWAII, UNIVERSITY OF HAWAII AT HILO, HAWAII. <br />WHEREAS, applicant State of Hawaii, University of Hawaii at Hilo, has requested to <br />extend the sewer in accordance with section 21-26, Hawaii County Code, to service parcel 2-4- <br />001:005 only and no additional properties will currently be made accessible by this extension; <br />and <br />WHEREAS, the proposed sewer extension is actually a parallel sewer line on Kawili <br />Street that will handle all wastewater generated from future construction on parcel 2-4-001:005 <br />(the future China -U.S. Center). A typical sewer lateral connection to parcel 2-4-001:005 is not <br />feasible due to inadequate sewer capacity on Kawili Street's existing Public Sewer. Therefore, a <br />proposed parallel sewer extension on Kawili Street is required to handle the future wastewater <br />generated from parcel 2-4-001:005; and <br />WHEREAS, applicant State of Hawaii, University of Hawaii at Hilo, will bear the total <br />cost of the construction and in the future, will be eligible to exercise conditions under section 21- <br />28(a), Hawaii County Code, pertaining to receipt for 10 years after completion of the extension <br />one-half of all moneys for sewer charges collected by the County from other properties, if any, <br />connecting to the extension provided the total of such reimbursement shall not exceed the cost <br />incurred by the applicant to construct the extension. Plans to reimburse the applicant for <br />construction of the sewer extension shall require the approval of the County Council by <br />resolution; and <br />WHEREAS, pursuant to section 21-26.1(b), Hawaii County Code, the Director of the <br />Department of Environmental Management has approved the application and recommends the <br />approval of the Council; and Attachment "A" is the application with construction plans as <br />supporting documentation; and <br />WHEREAS, sewer extensions are beneficial to the community by eliminating the need <br />of alternative waste treatment options and reducing the amount of pollutants reaching the <br />groundwater and the coastal waters, resulting in a cleaner, healthier environment; and <br />WHEREAS, section 21-26.1(a), Hawaii County Code, requires that the council approve <br />all sewer extensions; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the <br />sewer extension to Kilauea/Kawili Street Intersection for the State of Hawaii, University of <br />Hawaii at Hilo, is hereby approved. <br />
