In accordance with Section 2-162.1, Hawaii County Code 1983 (2005 Edition) as
amended, transmitted herewith for the County Council's consideration and action is a
proposed resolution relating to the in lieu fair share contribution in an amount of
$16,191.99 for the contribution toward the purchase of a new fire truck to support fire
protection functions, as required by Condition R (a) of the above-referenced Ordinance
No. 92 40. For your inforniation, we have enclosed a copy of Ordinance No. 92 40 and
the applicant's request for in lieu fair share credits.
The payment and delivery of the fire truck are scheduled for early June. In addition,
Kohala Ranch LLC's representative, William L. Moore, will not be available for the May
20, 2009 County Council Meeting. Therefore, we are requesting the subject resolution be
waived from the committee and placed on the full County Council agenda for the May 6,
2009 County Council Meeting.

Subject: Fair Share Contribution for Fire Truck
North Kohala Coast Volunteer Fire Company-14A
In 1993, a devastating fire raged through Kohala Estates. In response to that'event, the
community organized themselves to form a voluhteer fire company. North Kohala Coast
Volunteer Fire Company came irito being in early 1995. Since that time, the unit has responded
to emergencies along Akoni' Pule Highway from Kawaihae fo Hawi.
In July 2007, there were a series of intentionally-set fires all along Akoni Pule Highway. Two of
the three vehicles from the volunteer unit were damaged beyond repair. They were left with no
tanker to deliver water to fires.
In response to this, the Kohala Ranch Community Association (KRCA) initiated a fund drive in
the fall of 2007 to raise funds to secure a tanker truck. The Hawaii County Fire Department has
identified a new truck for a cost of approximately $159,000 that meets all their specifications.
KRCA has raised approximately $143,000 from the community for the purchase of this fire
truck.
Kohala Ranch Development Corporation has agreed to contribute $16,191.74 to assist in the
acquisition of the fire truck, provided it can receive 33 credits against any future fire fair shaze
contributions that it may be responsible for.
More specifically, KRDC is seeking your concurrence that upon donation of the above amount to
the North Kohala Coast Volunteer Fire Company-14A, it will receive 33 single family dwelling
credits that can be used against any future fire fair share requirements it may be responsible for.
These credits may be used by KRDC to satisfy any existing or future fire fair share requirements
within the North Kohala district. Furthermore, should the County adopt an impact fee ordinance;
these credits maybe used to satisfy fire impact fee requirements for 33 single family residential

SECTION 2. This change in district classification is
conditioned upon the following: (A) the applicant, successors
or assigns shall be responsible for complying with all of the
stated conditions of approval; (B) the effective date of the
rezoning shall be (1) when the applicant provides assurance

satisfactory to the Departments of Water Supply and Planning,
upon consultation with the State Department of Health and the
Department of Land and Natural Resources, that a water
source(s) of sufficient quality and quantity has (have) been
established within two years from the enactment of this
ordinance; provided that a maximum one-year extension may be
granted by the Planning Director with reasonable and sufficient
justification; and (2) an agreement, together with the
appropriate bond, surety or other security deemed acceptable by
the Planning Director, is executed between the applicant and
the County through its Departments of Water Supply and Planning
for the actual development of a proven source(s) and its water
transmission and distribution system within one year from the
official date of compliance with Condition B(1); provided that
a one-year extension may be granted by the Planning Director
with reasonable and sufficient justification; (C) upon
compliance with Condition B(1) and (2), the project shall be
developed in two increments. The first increment shall consist
of a maximum of 808 residential units/lots and the commercial
zoned areas. The second increment shall consist of the
remaining 682 residential units/lots. Subdivision plans may be
submitted for the second increment only after development has
occurred in the first increment as determined by the Planning
Director. "Development" means that building permits have been
issued for dwelling units/lots and construction has been

partially completed to the extent that roofs have been
constructed on a minimum of twenty-five percent of the number
of lots/units proposed for the first increment. In lieu of
actual construction, the applicant may enter into an agreement
with the Planning Department to assure the County that the
dwellings will be constructed by way of a surety bond,
certified check or other security acceptable to Corporation
Counsel and the Planning Department. Upon final execution of
such agreement and filing of the security with the County,
subdivision plans for the second increment may be submitted
prior to the actual construction of the dwellings in the first
increment; (D) upon compliance with Conditions B(1) and (2),
subdivision plans for the first zoned increment or portions
thereof, shall be submitted to the Planning Department within
one year from the effective date of the rezoning as determined
in Condition B and tentative subdivision approval shall be
secured within one year thereafter. Final Subdivision approval
shall be secured within two years from the date of submitting
final subdivision plans; (E) a waste water treatment plant
shall be constructed to service the residential and commercial
developments meeting with the approval of the Department of
Health; (F) a drainage system meeting with the approval of the
Department of Pubic Works shall be installed; (G) a 100-foot
wide landscaping buffer shall be provided along the mauka and
makai boundaries of the project site. The mauka landscaping

buffer area or portions thereof may be used for utilities and
for roadway access to and through the project area to allow
improved traffic circulation. The landscaping buffers shall be
delineated on plans submitted for subdivision and duly recorded
with the Bureau of Conveyances; (H) Eull channelization
improvements at the Kohala Mountain Road-Kohala Ranch Road
intersection, including acceleration/deceleration lanes and a
left-turn storage lane, shall be installed meeting with the
requirements of the Department of Transportation-Highways
Division. Intersection improvements shall be constructed
within eighteen months of the effective date of the rezoning as
determined by Condition B. The cost of such improvements shall
be borne by the applicant and shall not be credited to or
deducted from the applicant's fair share contribution for road
and traffic improvements, as required under Condition R; (I) a
traffic monitoring program of the Akoni Pule Highway and Kohala
Ranch Road intersection shall be coordinated by the applicant
with the Department of Transportation-Highways Division.
Required improvements, as determined by the findings of the
monitoring program and approved by the State Department of
Transportation-Highways Division, shall be installed in a
manner meeting with the approval of the Department of
Transportation-Highways Division. The cost of such
improvements shall be borne by the applicant and shall not be
credited to or deducted from the applicant's fair share

contribution for road and traffic improvements, ~s required
under Condition R; (J) the applicant may be required to
participate in the construction of any regional roadway
improvements pursuant to an adopted plan, provided that any
costs borne by the applicant shall be credited and limited to
the amount of its fair share contribution for regional road and
traffic impacts, as required in Condition R; (K) the applicant
shall set aside a minimum of 5 acres of land within the project
site for active park and recreational uses. The active park
site shall be improved by grading and grassing in conjunction
with final subdivision approval of any residential subdivision
ands shall remain in private ownership. The park development,
maintenance and operational plan shall be submitted for review
and approval by the Planning Department, in consultation with
the. Department of Parks and Recreation; (L) a minimum 14-acre
nature park shall be set aside and established in conjunction
with final subdivision approval of the affected subdivision in
the second zoned increment. A nature park development and
management program shall be submitted for review and approval
by the Planning Department, in consultation with the Department
of Land and Natural Resources, prior to submitting subdivision
plans for the affected portion of the second increment. The
nature park, maintenance and operational plan shall include,
but not be limited to, delineation of and rationale for park
boundaries; identification of tree 'ohai colony to be
preserved; listing of native spec

aies to be planted within thepark; proposed interpretive
signage; and maintenance provisions; (M) the applicant shall
construct or cause the Construction of a park, not to exceed
five acres in area, on land provided or caused to be provided
by the County or State. The park, the cost of which shall not
exceed $700,000, shall consist of necessary land area, grassed
play field, restrooms, and other facilities as may be required
by the County and shall be completed within eighteen months of
the effective date of the rezoning as determined by Condition
B, provided that the County may require other recreational
facilities at equivalent cost to be constructed if it
determined that community needs would be better served. In
lieu of construction of the facility, the Planning Department
in consultation with the Department of Parks and Recreation,
may require the applicant to provide a contribution to the
County in the amount of $700,000 for regional recreation needs;
(N) an .historic preservation mitigation plan shall be prepaced
and submitted for approval by the Planning Department, in
consultation with the Department of Land and Natural Resources,
prior to submitting plans for preliminary subdivision or plan
approval review. The plan shall consist of an archaeological
data recovery plan and a preservation plan. Approved
mitigation measures shall be implemented prior to or in
conjunction with any land alterations in the project area;
(O) should any unidentified sites or remains such as artifacts,

shell, bone, or charcoal deposits, human burials, rock or coral
alignments, pavings or walks be encountered, work in the
immediate area shall cease and the Planning Department shall be
immediately notified. Subsequent work shall proceed upon an
archaeological clearance from the Planning Department when it
finds that sufficient mitigative measures have been taken; (P)
to ensure that the Goals and Policies of the Housing Element of
the General Plan are implemented, the applicant shall work with
the Office of Housing and Community Development and the
Planning Department to formulate a housing plan for the
development, which shall be consistent with the housing policy
of the Hawaii County Housing Agency. This housing plan shall
be approved by the County Housing Agency prior to final
subdivision approval of any portion of the residential zoned
area. As part of this housing plan, the applicant shall
satisfy up to fifty percent (50%) of its affordable housing
requirement in a manner meeting with the approval of the
Department of Hawaiian Home Lands (DHHL); provided that the
satisfaction of the housing requirements shall be related to
affordable housing upon DHHL lands at Kawaihae for households
which qualify under the affordable housing income guidelines
established by the Hawaii County Housing Agency. The applicant
shall notify the County Housing Agency of any intent to sell,
lease, assign, place in trust, or otherwise voluntarily alter
the ownership interest in the property prior to visible

commencement of construction on the property; provided further
that the applicant may transfer ownership in the property to an
affiliate or in a manner consistent with prior representations
to the County Housing Agency. In the event the applicant
conveys an ownership, leasehold, or controlling development
interest in any residential area prior to the approval of the
housing plan by the Hawaii County Housing Agency, a pro rata
portion of the affordable housing requirement, based upon unit
density of the land affected by such sale, lease or conveyance,
shall be satisfied by an in-lieu payment by the applicant upon
such conveyance of an ownership, leasehold or controlling
development interest of that residential area. The in-lieu
payment for the residential area shall be based on a maximum
density for the residential area, as determined by the
applicant with the concurrence of the Planning Director. Based
upon 1991 dollars, the total in-lieu payment value for the
project, based upon the 1,990 residential unit density proposed
by the applicant is $11,371,680; (Q) as agreed to by the
applicant, restrictive covenants in the deeds of all the
residential lots shall prohibit the construction of ohana
dwelling units. A copy of the proposed covenant(s) shall be
submitted to the Planning Department for review and approval
prior to final subdivision approval of each residential
subdivision. Written assurance for implementation of this
condition, which has met with the approval of the Planning

Department, shall be submitted to the Planning Department prior
to Einal subdivision approval of each subdivision. A copy of a
typically recorded covenant shall be filed with the Planning
Department within one year from the date of final subdivision
approval of each subdivision; (R) the applicant shall pay its
fair share contribution to address potential regional impacts
of the project with respect to fire, police and solid waste
disposal facilities and roads. The fair share contribution
shall be initially based on the representations contained
within the change of zone application and may be increased or
reduced proportionally if unit counts or commercial areas are
adjusted. The fair share contributions described below shall
be adjusted annually based on the percentage change in the
Consumer Price Index (CPI). A pro rata portion of the
contribution, based upon the unit density and commercial area
of the land affected, shall become due and payable, a*_ the
discretion of the County, in the event the applicant conveys an
ownership, leasehold, or controlling development interest in
the land prior to receiving its initial subdivision approval or
final plan approval in the proposed project. Subsequent to the
initial subdivision approval or final plan approval, a pro rata
portion of the contribution shall be paid by the applicant upon
conveyance of an ownership, leasehold, or controlling
development interest of any residential lot or unit or, in the
case of commercial development, upon conveyance of an

ownership, leasehold, or controlling development interest of
any commercial lot or on or before the issuance of a building
permit for any commercial structure, whichever occurs first.

based on a maximum density for each lot as determined by the
applicant with the concurrence of the Planning Director. The
Fair Share contributions shall be as follows: (a) $520,000 to
the County to support the fire protection functions in the
Kawaihae region. In lieu of such contribution, the applicant
shall, if required by the Fire Department, either (1) provide
2.5 acres of land on site for the construction of a fire
station or (2) apply the fair share contribution to secure land
outside of the project area for the construction of a fire
station; (b) $266,000 to the County to support police functions
within the North Kohala-South Kohala region; (c) $4,020,000 to
the State or County to support road and traffic improvements
within the North Kohala-South Kohala region. In lieu of paying
the fair share contribution, for roads and traffic
improvements, the applicant, with the concurrence of the
Planning Director and the State Department of Transportation
Highways Division, may construct certain off-site improvements
to address regional roadway impacts; and (d) $235,000 to the
County to support solid waste disposal Functions within the
West Hawaii region; (S) the applicant shall develop a solid
waste processing facility within the project area to satisfy

the solid waste disposal needs of the project. The processing
facility shall be open and operational prior to the occupancy
of the first residential unit within the project area and shall
be operated and maintained privately. In addition, the
applicant shall pay its fair share contribution of $235,000 as
may be adjusted annually based on the Consumer Price Index
(CPI). The fair share contribution shall be paid in accordance
with the provisions in Condition R. Upon construction of a
future public solid waste processing facility serving the
Kawaihae region, the applicant shall be entitled to use such
public facility for the processing of the project's solid waste
and may terminate the private facility within the project area;
(T) the applicant shall work with the State Department of
Education and Planning Department to provide its pro rata share
for school facilities. The pro rata share determination and
its implementation (i.e. construction of classrooms or funding)
shall be approved by the Planning Director, in consultation
with the Department of Education, in conjunction with final
subdivision approval of any residential subdivision or final
plan approval for any area of development; (U) the applicant
shall disclose to all potential buyers of lots or units within
the proposed project that internal infrastructure and community
facilities shall be developed and maintained privately and that
the County is not obligated to construct any public facilities
within the project area; (V) the applicant shall inform all

prospective owners of units or lots within the project area
that possible odor, noise, and other impacts may result from
eaisting or future agricultural activities on surrounding or
nearby lands which are zoned for agricultural uses;
(w) traffic to and from the proposed project shall not be
permitted, eacept for emergency purposes, over Ala Kahua Road
within the Kohala Estates subdivision, unless a majority of lot
owners within Kohala Estates subdivision consent in writing to
such use of Ala Kahua Road or unless Ala Kahua Road is
dedicated to the County, and the County allows such use;
(X) comply with the conditions of the State Land Use
Commission's Decision and Order; (Y) comply with all applicable
laws, rules, regulations and requirements; (Z) should the
Council adopt a Unified Impact Fees ordinance setting forth
criteria for the imposition of exactions or the assessment of
impact fees, conditions included herein may, at the developer's
election, be satisfied by performance in accordance with the
requirements of the Unified Impact Fees Ordinance; (AA) an
annual progress report shall be submitted to the Planning
Department prior to the anniversary date of the approval of
this change of zone. The report shall address in detail the
status of the development of each area (including number of
lots created and the number of units constructed) and the
compliance with the conditions of approval. This condition
shall remain in effect until all of the conditions of approval
have been complied with and the Planning Department

acknowledges that further reports are not required; and,
(BB) an extension of time for the performance of conditions,
except Condition B, within the ordinance may be granted by the
Planning Director upon the following circumstances: 1) the
non-performance is the result of conditions that could not have
been foreseen or are beyond the control of the applicant,
successors or assigns, and that are not the result of their
fault or negligence; 2) granting of the time extension would
not be contrary to the General Plan or Zoning Code; 3) granting
of the time extension would not be contrary to the original
reasons for the granting of the change of zone; 9) the time
extension granted shall be for a period not to exceed the
period originally granted for performance (i.e., a condition to
be performed within one year may be extended for up to one
additional year); and 5) if the applicant should require an
additional extension of time, the Planning Director shall
submit the applicant's request to the County Council Eor
appropriate action. Further, should any of the conditions not
be met or substantially complied with in a timely fashion, the
Director shall initiate rezoning of the area to its original or
more appropriate designation.
SECTION 3. Zn the event that any portion of the ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.

SECTION 4. This ordinance shall take effect upon its
approval.
