(including, but not by way of limitation, attorney's fees and court costs) arising out of injury <br /> to persons, including death, or damage to property, including any and all costs resulting <br /> from environmental contamination, azising out of or incidental to any act or omission of the <br /> contractor in the performance of its obligations and shall require the contractor to maintain <br /> a liability insurance policy to cover operations and closure; <br /> (F) The source material to be used for post harvest treatment at the facility shall be limited to <br /> cobalt-60 or an electron machine source; <br /> (G) The post harvest treatment facility shall not be constructed in a tsunami inundation area; <br /> (H) The facility shall be designed and constructed in consultation with the US Geological <br /> Survey-Hawaii Volcanoes Observatory to consider seismic activity and siting <br /> recommendations in relation to other volcanic hazards; and <br /> (I) An emergency response plan shall be prepared by the permittee in consultation with the <br /> Hawaii County Civil Defense Agency, the State Depaztment of Health and other agencies <br /> responsible for emergency response activities. <br /> SECTION 4. In the event that any portion of this ordinance is declared invalid, such invalidity <br /> <br /> shall not affect the other parts of this ordinance. <br /> SECTION 5.
