(including, but not by way of limitation, attorney's fees and court costs) arising out of injury to persons, including death, or damage to property, including any and all costs resulting from environmental contamination, azising out of or incidental to any act or omission of the contractor in the performance of its obligations and shall require the contractor to maintain a liability insurance policy to cover operations and closure; (F) The source material to be used for post harvest treatment at the facility shall be limited to cobalt-60 or an electron machine source; (G) The post harvest treatment facility shall not be constructed in a tsunami inundation area; (H) The facility shall be designed and constructed in consultation with the US Geological Survey-Hawaii Volcanoes Observatory to consider seismic activity and siting recommendations in relation to other volcanic hazards; and (I) An emergency response plan shall be prepared by the permittee in consultation with the Hawaii County Civil Defense Agency, the State Depaztment of Health and other agencies responsible for emergency response activities. SECTION 4. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 5. This ordinance shall take effect upon its approval.
