J, <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> BILL NO. 62 <br /> (Graft 3) <br /> ORDINANCE NO. <br /> AN ORDINANCE AMENDING ORDINANCE NO.96-68, AS AMENDED, RELATING TO PUBLIC <br /> IMPROVEMENTS AND FINANCING THEREOF FOR THE FISCAL YEAR JULY 1, 1996, TO JUNE 30, 1997. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. Ordinance No. 96-68, As Amended, Relating to Public Improvements and Financing Thereof <br /> for the Fiscal Year July 1, 1946, to June 30, 1997, is hereby amended by adding the following project: <br /> POST HARVEST TREATMENT FACILITY $2,000,000 <br /> (110-199-5199.04-I15) <br /> (May be applied to planning, environmental impact statement (EIS) <br /> re aration, design, construction, crop and product development, <br /> marketing, promotion and related infrastructure) <br /> SECTION 2. Funds for this project shall be provided from: <br /> General Obligation Bonds and/or Other Sources $2,000,000 <br /> SECTION 3. This appropriation shall be conditioned upon the following: (Al Any contracts related to the <br /> <br /> expenditure of these funds for this project shall be submitted to the Council for its review and authorization prior to <br /> signing by the Mayor; jBl An independent economic analysis of the post-harvest treatment facility shall take place <br /> prior to the expenditure of any other funds appropriated in this bill: (Cl The County shall not construct a post <br /> <br /> harvest treatment facility on ceded or Hawaiian Homes lands: (Dl Money for construction and design shall not be <br /> released until a final environmental impact statement required by <br /> applicable law is accepted: (El Contracts shall <br /> include a plovision that the contractor hold harmless. indemnify and defend the County. its officers. employees. <br /> <br /> ~gpresentatives and agents. from and against any claim. action. loss. damage. injury. liability. cost and expense of <br /> <br /> whatsoever kind or nature (including. but not by way of limitation. attorney's fees and court costsl arising out of <br /> iniurv to persons. including death. or damagg to property. including and all costs resulting from environmental <br /> contamination. arising out of or incidental to any act or omission of the contractor in the performance of its <br /> <br /> 4¢y.gations: and (Fl The source material to be used for Host harvest treatment at the facility shall be limited to <br /> cobalt-60 or an electron machine source. <br /> SFC'T[ON 4 In the event that any portion of this ordinance is declared invalid. such invalidity shall not <br /> <br /> affect the other parts of this ordinance. <br /> SECTION 5.
