Arakaki, Chairman <br />and Members of the County Council <br />Page 7 <br />principle regarding the commitments and allocation of water for this requested change of <br />zone together with the applicant's recently approved change of zone for TMK: 7-4-8:63 <br />(REZ 922). The proposed development has or will have adequate water commitments <br />from the Department of Water Supply to meet the needs of the proposed development. <br />The recommendations of the Department of Water Supply have been included as <br />conditions of approval for this recommendation. <br />Wastewater from the proposed development will be disposed into the County's <br />Kealakehe Wastewater Treatment Facility, in accordance with the Department of Public <br />Work's requirements. If applicable, the applicant will also comply with the Department <br />of Health's requirements for underground injection systems and secure NPDES permits <br />for discharges into State waters. The applicant will also consult with the Army Corps of <br />Engineers to determine if any permits are required for the project. Additionally. the <br />applicant will abide by all applicable State and County air quality and noise level control <br />standards during the pre -construction and construction phases of the project. <br />The proposed rezoning and the resulting future development of this property will <br />increase the residential population in the area, thereby also increasing demand for <br />additional space at area schools, including Kealakehe Elementary, Intermediate and High <br />Schools. One of the conditions of the State Land Use Boundary Amendment from the <br />Agricultural to the Urban District for the 432.91 -acre area which includes the project site <br />requires that the County ensure that developers and landowners contribute to the <br />development, funding and/or construction of public school facilities on a fair share basis, <br />if the proposed land uses generate the need for such facilities. The Department of <br />Education has suggested a condition of approval for the subject request to impleinent the <br />LUC condition, so that the County of Hawaii can ensure that the developer satisfies the <br />Department of Education's fair -share requirements. This condition of approval is <br />included as part of the recommendation. Therefore, the proposed multiple -family <br />residential and commercial development will be developed in an area that is or can be <br />adequately served by water, utilities, sewers, schools and transportation systems <br />The Flood Insurance Rate Maps (FIRM) indicate that the property is located in <br />Zone "X", areas determined to be outside of the 500 -year flood plain. There are no <br />significant drainageways anticipated. While there are no indications of surface water <br />flow on-site, the applicant will abide by all applicable County guidelines for run-off <br />generated by the development. <br />According to the applicant's Environmental Report, plants found on the property <br />were not listed, proposed or candidates for threatened and endangered species. Nor were <br />any plants found to be species of concern. All of the plants on the site can be found in <br />similar lowland, dry habitats throughout the main Hawaiian Islands. The survey also <br />found no sensitive native plant -dominated communities on the site. The existing <br />
