and archaeological sites to be approved by the Planning Director, m <br /> consultation with the Department of Land and Natural Resources m <br /> conJunction with the detail mitigation plan for the park area situated m the <br /> Conservation distuct <br /> <br /> (I) Pnor to final approval of a small lot subdivision plat within [he subJec[ property, <br /> the applicant shall convey to the County of Hawau by way of a perpetual <br /> easement the nght to public access and recreational use of its pm•ately o•vned <br /> coastline park and trails, provided, that restnctions will be allowed to be <br /> established by the apphcaiit, subJec[ to the approva] of the Planning Director, to <br /> promote public health and safety and the general secunty of the premises for <br /> residents and guest of the protect to protect the area' pristine condition, a id to <br /> muumize any liability to the applicant, pursuant to Chapter 520, Section 520-4, <br /> Haw•an Revised Statutes The applicant shall retain ownership of its coa•.thne <br /> park and trails m fee simple .ind maintain all lands m the coastline park area and <br /> operate such facility for public recreational use m accordance with the above <br /> teens and conditions This condmon shall no[ be applicable to any roadway, trail <br /> or other rights of way, which are deemed public highways or trails as defined m <br /> Chapter 264, Hawau Revised Statutes, <br /> (J) Should any unidentified sites or remains such as am facts, shell, bone, or charcoal <br /> deposits, human burials, rock or coral alignments, pavings or walls be <br /> encountered, work m the unmediate area shall cease and the Planning Du ector <br /> shall be immediately notified Subsequent work shall proceed upon an <br /> archaeological clearance from the Planiimg Director when tt finds that sufficient <br /> mitigative measures have been taken, <br /> (K) A solid waste management plan shall be prepared meeting with the approval of <br /> the Department of Public Works prior to submitting plans for subdivision review <br /> The Plan shall include, but not be limited to, the management of construe tion <br /> solid +a•aste as well as operating and domestic solid waste generated by the subJec[ <br /> property Approved recommendations and mitigation measures shall be <br /> implemented at a time and m a mamier meeting w•rth the approval of the <br /> Department of Public ~4'orks, <br /> _72_ <br /> <br />
