<br /> <br /> <br /> <br /> <br /> <br /> J Yoshimoto, Council Chair and <br /> Members of the Hawai'i County Council <br /> Page 2 <br /> August 6, 2009 <br /> <br /> <br /> Pursuant to the County Procedures Manual for Participation in the Hawai'i State <br /> Revolving Fund Loan Program, prepared by the Wastewater Branch of the Hawai'i <br /> Department of Health in April 1994, part of the loan application process requires a <br /> "resolution or ordinance passed by the County Council which authorizes the SRF loan <br /> application and identifies the dedicated source(s) of revenue (i.e., general obligation <br /> bonds) which will fund the project and repayment of the loan with interest." The <br /> Council's authorization of the issuance of general obligation bonds will serve as a pledge <br /> of its general obligation authority as security for repayment of the loan and interest. <br /> Also enclosed is a bill for an ordinance amending the Capital Budget by adding the Queen <br /> Lili'uokalani Village Large Capacity Cesspool Replacement (SRF funding) project into this <br /> fiscal year's Capital Budget. <br /> <br /> The Department of Environmental Management humbly request a waiver from the Finance <br /> Committee and to have these bills heard at the next Council meeting scheduled for <br /> August 19, 2009 so that bid notice publication for this project may meet the <br /> August 31, 2009 deadline, in order to stay qualified as a "backup" project for American <br /> Recovery and Reinvestment Act (ARRA) of 2009 portion of the Water Pollution Control <br /> Revolving Fund. Earlier this year, the County had included the QLVLCCR project on its list of <br /> projects eligible for ARRA funding. <br /> <br /> These bills will allow the QLVLCCR project to comply with the upcoming August 31, 2009 <br /> ARRA bid advertisement deadline, necessary to qualify for ARRA funding. As the <br /> QLVLCCR project is a backup ARRA project, it may only qualify for ARRA funds if another <br /> county fails to meet the specified ARRA deadlines and the State Department of Health <br /> transfers the funds from the failed project to other qualifying ARRA back-up projects.
