Ane <br />Keohokiilole Hil!:hway (6A) shall be dedicated to the County within six <br />(6) months of jts completion. <br />d. The applicant shall complete the preliminary enl!:ineerinl!: for <br />technical feasibility of the Ane Keohokiilole Hil!:hway (Road 6A) and <br />have the roadway environmentally cleared for construction for a <br />minimum of 500 linear feet by 200 feet wide from the subject property <br />boundary into the adjacent properties. <br />4. New Connector Road (Road I - Kona CDP): <br />.!h The right-of-way width of Road I within the State lands shall be 120 feet. <br />The section of Road I from the State property to the Miimalahoa <br />Highway (Hwy. 1901 within the private properties shall have a right-of- <br />way width of 88 feet. <br /> <br />b. Applicant shall construct Road I (the extension of Ane Keohokiilole <br />Hil!:hway from the north side of the project district and continuinl!: <br />north and east to the Miimalahoa Hil!:hway), at its sole expense as a <br />two-lane County-dedicable collector road, including shoulders and swales. <br />The final design and maximum grade of Road I shall be determined by the <br />Director of Public Works after consultation with the Planning Director. <br /> <br />c. The applicant shall continue preparatory work for the design of Road I, <br />including working with the County of [Hawaii] Hawai'i to secure the <br />right-of-way for Road I across State ofHawai'i lands and providing <br />information necessary for the County of Hawai'j to arrange the right-of- <br />way over privately owned lands. The applicant shall provide Quarterly <br />information to the planninl!: director on the status of nel!:otiations for <br />easements for the ril!:ht-of-way. If the applicant cannot or does not <br />obtain the easements within 18 months, the county shall bel!:in <br />eminent domain proceedinl!:s for the ril!:ht-of-way. The applicant shall <br />be responsible to the County for reimbursement of any and all costs <br />associated with the fulfillment of the applicant's oblil!:ation under this <br />al!:reement.
