Ford, Council Member j}u..~ ~ <br />SUBJECT: Proposed Amendment to Resolution No. 265-09 <br /> <br />Attached please find proposed amendments to Resolution No. 265-09, urging the protection of <br />Hawai'i County's home-rule authority in all matters relating to agricultural policy. The proposed <br />amendments is in Ramsayer format, and bolded for illustrative purposes. A draft copy of <br />Resolution No. 265-09, Draft 2, is attached with the proposed amendments incorporated therein. <br />The amendments are as follows: <br /> <br />1. Insert two whereas clauses after the fourth whereas clause, and is to read as follows: <br /> <br />"WHEREAS. the delicate nature of Hawai'i's unique ecosystems. and the <br />health. safety. and welfare of Hawai'i's residents are better maintained and <br />protected by its respective counties: and <br /> <br />WHEREAS. by the State attempting to exact land use regulatory limits on <br />the counties relating to agricultural issues usurps county authority and repudiates <br />home rule principles. without just cause: and" <br /> <br />2. Amending the Be It Finally Resolved clause by inserting language, and is to read as <br />follows: <br /> <br />"BE IT FINALLY RESOLVED BY THE COUNCIL OF THE COUNTY OF <br />HAW AI'I that the County Clerk shall forward a copy of this resolution to the Honorable <br />William P. Kenoi, Mayor, County of Hawai'i; the Honorable Charmaine Tavares, Mayor, <br />County of Maui; the Honorable Bernard P. Carvalho, Jr., Mayor, County of Kaua'i; the <br />Honorable Mufi Hannemann, Mayor, City and County of Honolulu; the <br /> <br />Comndlo.
