Ford, Council Member a <br /> <br /> SUBJECT: Transmitting Bill 163, Draft 2, relating to an ordinance amending Section 25-8-3 <br /> (North Kona Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii <br /> County Code 1983 (2005 Edition): Applicant: HU-KO-PA, LLC. <br /> <br /> Attached please find Bill 163, Draft 2, which incorporates those amendments contained in <br /> Communication No. 578.1, including subsidiary amendments that were duly approved at the <br /> December 15, 2009, Committee on Planning meeting. <br /> <br /> These amendments include the following: <br /> <br /> 1. Removed Condition "D" as contained in Communication No. 578.1 with a subsidiary <br /> amendment to return to language originally in Bill 163. <br /> <br /> 2. Amended Condition "G" as contained in Communication No. 578.1 with a subsidiary <br /> amendment to read as follows: <br /> <br /> "The developer, the homeowner, and/or homeowner's association shall be <br /> responsible for any landscaping within the right-of-way, meeting with the approval <br /> <br /> of the Department of Public Works, and shall provide repair to any public facility <br /> damaged by the landscaping." <br /> <br /> By the request of Department of Works Director Warren Lee and as approved by the <br /> Planning Committee, this subsidiary amendment was removed from Condition "G" and <br /> <br /> added after the last sentence in Condition "I." <br /> BJF/dkr <br /> Att. <br /> Comm.
