'-:,-'- . <br />:';;. :,",:- , <br /> <br />.."S.>rATEOFHAWAII. <br />-:".' .' ." <br /> <br />RESOLUTION NO. <br /> <br />24498' <br /> <br />A RESOLUTION AUTHORIZINGTHECOUNTY OF HA WAIl TO ENTER iN A <br />DEVELOPMENT AGREEMENT WITH 1250 OCEANSIDE PARTNERS. <br /> <br />WHEREAS, the Hawaii State Legislature, under section46-123, HawaiiRevised <br />Statutes, granted authorization to the County of Hawaii (CoUnty) to enact an ordinance <br />authorizing the executive branch oftheCo!lIlty toentet into a development agreement with any <br />person having a legal or equitable interest in real property fofthe development of such property; <br />and . <br /> <br />WHEREAS, the County Council enacted OrdinanceNo. 93-37(Chapter 30, Hawaii <br />County Code) establishing the requirements for Development Agreements, which ordinance was <br />passed into law on April 27, 1993; and . . <br /> <br />. . <br />. . <br />WHEREAS, pursuant to Section46-123, Hawaii Revised Statutes; and Chapter 30, <br />Hawaii Courity Code, the County adopted rules governing Development Agreements on May 16, <br />1995; and . <br /> <br />WHEREAS, 1250. Oceanside Partners, a Hawaii limited partnership, dba Oceanside 1250 <br />(Oceanside) is proposing to develop its lands inNorth and South Kona, Hawaii and has <br />submitted a Development AgreementapplicatioJ)'C) to the Office of the Mayor; and <br />. t:..>' <br /> <br />WHEREAS, Oceanside's development will ,proyide many public benefits to the County <br />through the zoning, SpeCial M. anagement Area' conditio~s of approv.al,' and the impo,sition .of on- <br />and off-site development requitenients;'and. '" ' " . . . .... ....,' . <br /> <br />WHEREAS, pursuantto Sec~ion '30.:5( d),~a)V~ji County Code, th~ Mayor, through the <br />Planning'Director, has submitted a fmal draft of the Oceanside Development Agreement, <br />attached as "ExhibitA", to the County COUn.:cil for its action; and <br /> <br />WHEREAS, pursuant to Section 30-4(b), Ha~aii CoUnty Code,' the Mayor may enter int~ <br />development agreements on behalf of the County. <br /> <br /> <br />NOW, THEREFORE BE IT RESOL VEDTHA T THE COUNCIL OF THE COUNTY . <br />. OF HA WAIl hereby finds that the provisions of the Oceanside Development Agreement, <br />. . attached as "ExhibitA", are consistent with the County General Plan, as amended; and <br /> <br />BE IT FURTHER RESOLVED; that the County Council hereby approves the Oceanside <br />Development Agreement as submitted in accordance with Section 30-5(d) of the.
