'd '. . , <br />DUNGATE AND ANGELICA L. DUNGATE, TAX MAP KEY (3)7-3-08:032, TO THE <br />COUNTY OF HAWAII. <br /> <br />C) <br /> <br />WHEREAS, PETER C. DUNGATE and ANGELICA L. DUNGATE, husband and wife, <br /> <br />are the owners of that certain roadway lot located in Kaloko, North Kona, Hawaii, specifically <br /> <br />identified as Tax Map Key (3)7-3-08:032, being more particularly described in Exhibit A and <br /> <br />delineated on Exhibit B attached hereto; and <br /> <br />WHEREAS, PETER C. DUNGATE and ANGELICA L.DUNGATE were required to . <br /> <br />provide a ten-foot future road widening strip to the County at no cost to the County, pursuant to <br /> <br />condition E of Ordinance No. 97-39; and <br /> <br />WHEREAS, PETER C. DUNGATE and ANGELICA L. DUNGATE have received <br /> <br />approval from the County of Hawaii's Department of Public Works and the Planning <br /> <br />Department for the road widening strip along the subject property, and are desirous of dedicating <br /> <br />the road widening strip to the County of Hawaii; and <br /> <br />WHEREAS, the road and widening strip is in acceptable condition for dedication; and <br /> <br />'WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the <br /> <br />Council may accept gifts which include the de9ication of land on behalf of the County of.. <br /> <br />Hawaii; <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF <br /> <br />HAWAII, in accordance with Article XIII, 'Section 13-12 of the Hawaii County Charter, and <br />
