Draft ,2 , <br />RESOLUTION PRESENTING A PLAN OF DISPOSITION FOR THE FORMER HAMAKUA SUGAR <br />COMPANY, INC. LANDS NOW UNDER COUNTY OWNERSHIP. . <br /> <br />WHEREAS, in 1994, the Council of the County of Hawaii agreed to accept approximately <br />4,400 acres ofland by Commissioner's Quitclaim Deed as a settlement for retroactive real property taxes <br />among Western Farm Credit Bank, the County of Hawaii and Hamakua Sugar Company, Inc.; and <br /> <br />WHEREAS, the settlement amount and the annual tax revenues lost as a result of the privat~ to <br />public ownership conversion have shifted the tax burden to other lands during this period of public <br />ownership; and <br /> <br />WHEREAS, the Council of the County of Hawaii, pursuant to Resolution No. 196-97, requested the <br />Mayor develop a disposition plan for the former Hainakua Sugar Company, Inc. lands now under County <br />ownership; and . <br /> <br />[WHEREAS, the Council of the County of Hawaii requested that the completed disposition plan be <br />forwarded to the Council of the County of Hawaii by resolution no later than May 1, 1998, for its review <br />and approval; and <br /> <br />WHEREAS, the Administration proposes to dispose of the former HamakuaSugar Company, Inc. <br />lands now under County ownership by a land exchange, on a value for value basis, for private property <br />which are required for certain County projects; and <br /> <br />WHEREAS, the acquisition oftheprivate lands will allow the County of Hawaii to address the need <br />for the improvements and expansion of various County facilities around the island; and. <br /> <br />WHEREAS, placing the former HamakuaSugar Company, Inc. lands now under County ownership <br />. into private ownership will return said lands to the tax rolls and make said lands available for further <br />agricultural development. <br /> <br />NQW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, <br />through its authority under Section 2-11, Hawaii County Code, that it approves of and directs the Finance <br />director or his authorized representative to proceed with the plan of disposition by land exchange, on a <br />value for value basis, of so much as may be necessary of the former Hamakua Sugar Company, Inc. lands <br />now under County ownership which are delineated on the list labeled Exhibit "A" for so much as may be <br />necessary of those certain properties under private ownership which are delineated on the list labeled <br />Exhibit "B" or for other lands as they may become available.] <br /> <br />WHEREAS, on May 1, 1998, the Mayor forwarded to the Council Resolution No. 267-98, which <br />approves a disposition plan that proposes land exchange with private landowners on a value-tor-value basis <br />in order to expand or improve the Hoolulu Park Complex, Kahaluu Beach Park parking, Honolii Beach <br />Park, AhalanuiPark and other lands as they may become available or may be necessary; and <br />
