FEDERAL PREEMPTION OF LOCAL ZONING AUTHORITY OVER SATELLITE <br />BROADCAST AND CELLULAR PHONE ANTENNAS. <br /> <br />. . . <br /> <br />WHEREAS, the Federal Communications. Commission has acted to pre~pi local zoning <br />authority over satellite broadcast antennas; and '. <br /> <br />WHEREAS;similar federal preemption for cellular phone antennas is being sought <br />before the Commission and Congress; and . <br /> <br />. , <br />WHEREAS, the zoningauthorityin mO,stStates is granted to local governments; and <br /> <br />. ' <br />. . <br />WHEREAS, local governments are closest to the people and, accordingly, are rpore <br />knowledgeable about and accountable for th~ consequences oflanduse decisions, and <br /> <br />WHEREAS, local governrilents' als9 are. sophisticated. enough to balance competing <br />interests when making their zoning decisions; anq . <br /> <br />. . <br /> <br />WHEREAS, for those reasons, federal preemption of local zoning authority for'any <br />industry is not in the best public Interest; and. <br /> <br />WHEREAS, the platform Qfthe National Association of Counties (NACo) includes a <br />position opposing any federal preemption of localzoning authority over satellite broa~cast and <br />cellular phone antennas and other land-based wireless communications facilities; and <br /> <br />. . <br /> <br />WHEREAS, the Council finds that all local governments with zoning authority should <br />support the NACo position; , <br /> <br />, " .- <br />. .' <br />NOW, THEREFORE, BE IT RESOLVED by the Council oftheCourityofHawai'i thatit <br />opposes federal preemption of local zoning authority over satellite broadcastahd cellular phone'.. <br />antennas; and . .' . <br /> <br />. . <br />BE IT FURTHER RESOLVED that the Council's representative 01} the Executive <br />Committee of the Hawaii State Association of Counties (HSAC) be authorized to vote for <br />HSAC's support of the NACo position opposing sU(~hfederal preemptionfor.theantennas and <br />other land based wireless communications facilities;, and . <br />
