<br />.-~" <br /> <br />. <br /> <br />. <br /> <br />COUNTY OF HAWAII <br /> <br /> <br />TATE OF HAWAII <br /> <br />RESOLUTIONNO.~ <br /> <br />SUPPORTING THEPROPOSED AMENDMENT TO THE INTERNET TAX FREEDOM <br />ACT. <br /> <br />WHEREAS, as a massive global network spanning not only state but international . <br />borders, the Internet and the related provision of online services and Internet access are matters <br />irivolving interstate and foreigri COlnmerce withiiithe jurisdiction of the United States Congress; <br />and:""" <br /> <br />WHEREAS, since the tax laws and regulations of many jurisdictions were established <br />long before the advent of the Internet, their application to this ~ew medium in unintended and <br />unpredictable ways may be an unacceptable burden on the nation's interstate and foreign <br />commerce; and , ., , . <br /> <br />WHEREAS, a consistent and coherent national policy regarding taxation of electronic <br />commerce conducted over the Internet can best be achieved by encouraging a cooperative <br />solution among federal, state, and local levels of government; and <br /> <br />WHEREAS, U.S. Representative Christopher Cox has drafted a newlnternettaxbill that <br />would be offered as a substitute amendment to the Iriternet Tax Freedom Act(HR 1054); and <br /> <br />WHEREAS, the new bill would impose athree~year moratorium on collecting six <br />specific types of state and local taxes which directly affect electronic commerce; and <br /> <br />WHEREAS, the bill would establish a Commission on Internet Commerce to examine a <br />number of issues involving sales and use taxes on remote commerce (catalog and Internet <br />transactions) and submit proposed legislation to the President ofthe United States; and <br /> <br />WHEREAS, the National Association of Counties (NACo) has endorsed the substitute <br />amendment to the Internet Tax Freedom Act (HRI054). <br /> <br />NOW, THEREFORE, BE IT RESOLVEHbythe Council of the County of Hawai'i that it <br />supports the proposed amendment to the Internet Tax Freedom Act and NACo's endorsement of . <br />the ~endment; and <br /> <br />BE IT FURTHER RESOLVED that the Council's rep~esentativeon the Executive <br />Committee of the Hawaii State Association of Counties (HSAC) be authorized to vote for <br />HSAC's support of the proposed amendment to the Internet Tax Freedom Act and NACo's <br />endorsement of it; and . <br />
