. . t~ ,- ~_:"_;" COUNTY OF HAWA ~ ,v~. , <Sl'ATEOF HAWAII RESOLUTION NO. 218 'S8. RESOLUTION-AUTHORIZING THE ACCEPTANCE OF A DONATION FROM THE HALAULA HEIGHTS STREET LI<}HT ASSOCIATION. WHEREAS, the Halaula Heights Street 'Light Association (Association) desires to dedicate ten (lO)street lights located on HalaulaStreet,aprivate road in Kohala, to the County of Hawaii (County); and ' WHEREAS, the Assoc,iation agrees to provide the County with an, access easement on Halaula Street for the future mairitenance and operation of said street lights; and ' WHEREAS, the total cost to remove the lights from private poles, to relocate them to joint poles, co-owned by the County, ,Hawaii Electric Light Company and GTE Hawaiian TelephoneCompariy, to energize the street lights, and to'pay the joint pole fees ,is estimated at Seven ThoUsand Five Hundred dollars ($7,500); and WHEREAS, the AssoCiation has agreed to pay for approximately two-thirds of the cost, which amoUnts to Five Thousand Twenty Five dollars ($5,025); and WHEREAS, Section 23-10, Hawaii,Courity Code, allows for the dedication of such street lighting systems since the subdivision was'platted in the County prior to December 21, 1966; and WHEREAS, Section 13-12, Hawaii County Charter, provides thatthe Council, on behalf of the County, may accept gifts of donations of money, securities or other personal property or of real estate or any interestiri real' estate. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HA WAIl that the Council 'accepts the donation of $5,025 from the Halaula Heights Street Light Association and dedication of the street light system when the street lights have been relocated, energized and alljoint pole fees paid. '
