<br />. <br /> <br />. <br /> <br />WHEREAS, the Councihvlshes todemonstrate its good faith and further promote a <br />positive and fair outcome for the general public and property owner alike; and <br /> <br />WHEREAS, the Council finds that it' is in the best interests of the County to acquire <br />the shoreline parcel described herein, and that such acquisition will be consistent with the <br />Hawai'i County General Plan and Code; and. <br /> <br />WHEREAS, the Council finds that time is of the essence in this matter. <br /> <br />. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY <br />, OF HAW AI'I that it requests the Mayor to negotiate with SoBay Hawai'i, Inc. to aquire the <br />beachfront parcel at Wai'aha, North Kona, Hawai'i, designated as TMK: (3)7-5-018:020 for <br />public purposes. <br /> <br />BE IT FURTHER RESOLVED thatthe negotiations take into consideration any and <br />all possibilities and/or combination oflandexchange, transfer of development rights, and/or <br />other means of acquisition that may be available under the Hawai' i County Code. <br /> <br />BE IT FURTHER RESOLVED that the Clerk ofthe Cou~ty of HawaFi transmit <br />copies of this resolution to the Honorable Mayor Stephen K.
