ENTERPRISE ZONE. <br /> <br />WHEREAS, the encouragement of beneficial economic development is a high priority for the <br />County of Hawaii; and . <br /> <br />WHEREAS, Chapter 209E, Hawaii Revised Statutes, which became law as Act 78, Session Laws <br />of Hawaii, 1986, authorizes the establishment of enterprise zones, to p:ovide incentives to "qualified <br />businesses" for investment and job creation in certain designated areas in the State; and <br /> <br />WHEREAS, Chapter 209E, HaWilii Revised Statutes, requires that in order for an area to be <br />designated as an "enterprise zone", the a(fectt~dcounty must make an ap!llication to the Department of <br />Business, Economic Development and Tourism of the State of Hawaii; and <br /> <br />WHEREAS, Chapter 31, Hawaii County Code, which became law with the approval of <br />Ordinance 94-8 by Mayor Stephen K. Yamashiro on January 26, 1994, the County of Hawaii established <br />procedures and criteria for "nomination, . designation, amendment, provIsion. of County incentives, and <br />other requirements for enterprise zones"; and. . <br /> <br />WHEREAS, Section 31-3, Hawaii County Code, authorizes the M":lyor or Council to nominate an <br />area to be designated as an enterprise zone, provided that all nominations shall be approved by the <br />Council by resolution and the nominated area must: <br /> <br />a) be located with one or'more contiguous United States census tracts; and <br /> <br />. . <br />.. . <br />b) have twenty-five percent or more of its population with ;pcomes below eighty percent of <br />the median family income of the County or; <br /> <br />c) have an unemployment rate in the area of at least one and a half times the average <br />unemployment rate for the State; and <br /> <br />WHEREAS, in nominating an area for designation a~ an enterprise zone, <br />the Mayor and Council are required to consider the economic conditions of the area, the potential benefits <br />which may accrue to the County from business and industrial developme.;lt in the area and the need and <br />potential for job creation in the area; and <br /> <br />. . <br />WHEREAS, the Hamakua Enterprise Zone, which was propos:;d by Resolution 94-275, was <br />approved by the State of Hawaii on October 17, 1994; and' . <br /> <br />WHEREAS; the Council, hasrevie~~d the applicable criteria a; ld has' considered the existing <br />conditions in the areas directly adjacent and contiguous to the present Ha::::lktia Enterprise Zone. <br /> <br />. NOW, THEREFORE, BE IT .RESOL VED BY THE COUNCIL OF THE COUNTY OF <br />HA WAIl, that after due and diligent consideration !If the applicablesta~(i;rds and the existing conditions <br />in' the area directly adjacent and contiguous to. the present' Hamaku~ Enterprise Zorie, it makes the <br />following findings: <br />
