J- <br /> <br />. <br /> <br />. <br /> <br />.. . <br /> <br />COUNTY OF HAWA <br /> <br /> <br />.rATE OF HAWAII <br /> <br />RESOLUTION NO. <br /> <br />315 98 <br /> <br />A RESOLUTION AUTHORIZING THE MAYOR TO NEGOTIATE AND EXECUTE AN <br />AGREEMENT WITH HAKALAU FARMS, LTD., TO SATISFY THE AFFORDABLE <br />HOUSING REQUIREMENT FOR KUPULAU HEIGHTS SUBDIVISION <br /> <br />WHEREAS, Hakalau Farms, Ltd. ("HFL"), owns approximately <br /> <br />10.23 acres of land at Kupulau, South Hilo, Hawai'i, covered by <br /> <br />tax map key number (3) 2-4-65: 4, hereinafter referred to as the <br /> <br />"Property"; and <br /> <br />WHEREAS, on July 3, 1997, Change of Zone Ordinance 97-91 <br /> <br />became effective and rezoned the Property; and <br />WHEREAS, Condition "I" of Change of Zone Ordinance 97-91 <br /> <br />requires that the applicant be responsible to provide affordable <br /> <br />housing; and <br /> <br />WHEREAS, the 'County proposes to enter into an agreement with <br /> <br />HFL to satisfy Condition "I" of Change of Zone Ordinance 97-91; <br /> <br />and <br /> <br />WHEREAS, the HFL has submitted a proposal, pursuant to <br />. Ordinance 98-1, to sati~fy the HFL's affordable housing <br />condition. <br /> <br />NOW, THEREFORE, BE IT RESOLYED BY THE COUNCIL OF THE COUNTY <br />OF HAWAI'I that.the Mayor is hereby authorized to negotiate and <br /> <br />execute an agreement with,Ha,kalau Farms; Ltd.,' to satisfy its <br />affordable housing condition imposed by Change of Zone <br /> <br />Ordinance 97-91. <br /> <br />0798H.EST <br />
