A condition of approval <br /> will require the applicant to submit a drainage study to the Department of Public Works <br /> and construct any required drainage improvements. Additionally, all development <br /> generated storm rim -off will he disposed ol'on-site and not allowed onto adjacent <br /> properties or roadways. <br /> • <br /> Electrical and telephone services can he made available to the property. Police <br /> services are located nearby on Kapi`olani Street. Fire services are located in downtown <br /> Hilo. Medical services are available at i -filo Medical Center. <br /> The request is not contrary to Chapter 205A, iIawai•i Revised Statues, <br /> relating to Coastal Zone Management Area. The subject property is located over a 1/4 <br /> mile from the shoreline and is not in the Special Management Area. Thus, the property <br /> will not he affected by coastal hazards and peach erosion. Thcrc are no identified <br /> recreational resources, historic resources. public access to the shoreline or mountain <br /> areas. scenic and open space preserves, coastal ecosystems, marine resources or other <br /> natural and environmental resources on the subject property. <br /> In view of the Hawai`i State Supreme Court's "DASH" and "Ka Pa'alcai 0 <br /> /Ca 4u:u decisions, the issue relative to native Hawaiian gathering and fishing rights <br /> miist be addressed in terms of the cultural, historical, and natural resources and the <br /> associated traditional and customary practices of the site: <br /> • Investigation of valued resources: An archaeological survey was not conducted <br /> because the property has previously been graded and is developed with a single - <br /> family dwelling. A flora and fauna survey of the property was conducted by <br /> Geometrician Associates, LLC in June 2009. <br /> The valued cultural. historical, and natural resources found in the rczonimsarea: <br /> The flora and fauna survey found no rare, threatened, or endangered floral or <br /> faunal species on the property, but recommended against removing or disturbing <br /> any vegetation during the months of.June and July in order to avoid impacts to <br /> any roosting endangered Hawaiian hoary bats, which are difficult to detect. <br /> • Possible adverse effect or impairment of valued resources: The property does not <br /> abut the shoreline, therefore Hawaiian gathering and fishing rights is not an issue. <br /> Native plants may he destroyed by ground alteration. There is no evidence that <br /> the flora in the area are particularly desired or used for cultural practices. <br /> • <br />
