<br />RESOLUTION AUTHORIZING THE GRANT OF A WATER LINE'EASEMENT AT
<br />KAAPOKO HOMESTEADS, SOUTH HILO, HAWAII, ISLAND, COUNTY AND
<br />STATE OF HAWAII, TAX MAP KEY NO. (3)2-7-05 TO MARTIN GANIGAN JR.
<br />,AND LINDA GANIGAN, MILES K. NAGATA AND LYNNE 1. NAGATA,
<br />DOROTHY D. PATAO, AND JAMES R. :KENN?J?Y AND LINJ?A C. KENNEDY
<br />
<br />WHEREAS, Chapter 2, Article 19, Section 2-1 1 1,oftheHawaii County ,Code provides
<br />that the County Council may, by resolution approve by a majority of its members,
<br />dispose of real property; and
<br />
<br />WHEREAS, the County of Hawaii is the owner of that certain homestead road located at
<br />Kaapoko Homestead, South Hilo, Hawaii, Island, County and State of Hawaii as shown
<br />on the enclosed tax maps; and
<br />
<br />WHERE AS, the Department of Public Works, Engineering Division, has issued a
<br />conditional permit to the owners to install the waterline, to serve their water needs; and
<br />
<br />WHEREAS, the owners is requesting the County of Hawaii to grant a waterline
<br />easement, subject, however, to reversion to the County upon termination or abandonment
<br />of the easement for the specific purposes for which it was granted; and
<br />
<br />WHEREAS, an independent appraiser determined that the fair market value of the
<br />waterline easement is $1,700.00 with an area of6,081 square feet.
<br />
<br />NOW, THEREFORE, BE IT RESOL YED BY THE COUNCIL OF THE COUNTY OF
<br />HAWAII, in accordance with Chapter 2, Article 19" Section 2-111 of the Hawaii County
<br />Code, that the County of Hawaii authorizes a grant of an easement for the installation of
<br />waterline to Martin and Linda Ganigan Jr., Miles K. and Lynne 1. Nagata, Dorothy D.
<br />Patao and James R. and Linda Co Kennedy.
