COUNTYOFHAWAI'I STATE OF HAW AI'I RESOLUTION NO. 296 10 RESOLUTION ACCEPTING THE GRANT OF EASEMENT AND BILL OF SALE FOR SEWER LINES AND OTHER RELATED FACILITIES, AT PUAPUA'A IKI 1ST, DISTRICT OF NORTH KONA, ISLAND, COUNTY AND STATE OF HAW AT'T, FROM SUFFOLK INVESTMENT, LLC AND PUNA DEVELOPMENT, LLC, TAX MAP KEY: (3)7-5-017: PORTION 001, PORTION 019 AND PORTION 039, TO COUNTY OF HAWAI'1. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAW An WHEREAS, Suffolk Investment, LLC and Pua'a Development, LLC are the owners of the sewerfacilities located at Tax Map Key (3)7-5-0 17:portion 00 I, portion 019 and portion 039, and delineated on Exhibit A attached hereto; and WHEREAS, the County of Hawai'i needs the grant of easement and bill of sale to maintain, operate, repair, remove and replace any and all sewer pipelines, equipment, structures, and other related facilities within Suffolk Investment, LLC and Pua'a Development, LLC's properties; and WHEREAS, the sewer facilities have been inspected and found to be in acceptable condition and are in compliance with the provisions of Chapter 21 of the Hawai'i County Code; and WHEREAS, Suffolk Investment, LLC and Pua'a Development, LLC have received approval from the County of Hawai'i's Department of Environmental Management for the sewer improvements made to the subject propel1ies; and WHEREAS, Article XTTT, Section 13-12 of the Hawai'i County Charter, provides that the Council may accept gifts of donations of money, securities or other personal property or of real estate, or any interest, in real estate, on behalf of the County of Hawai' i;
