CA -4: Relating to Civil Service Laws <br /> This proposal was brought forth by the director of human resources. It deletes <br /> several references to civil service laws from the charter. The reason for this change is <br /> because the state law is controlling when it comes to civil service laws. Thus, any <br /> references to civil services laws may be trumped by state provisions. To avoid any <br /> confusion or perceived conflicts, all references in the charter are proposed to be removed. <br /> CHARTER AMENDMENT NO. <br /> BE IT ENACTED BY THE PEOPLE OF THE COUNTY OF HAWAI`l: <br /> Section 1. Article III, section 3 -6, Hawai`i County Charter, is amended by amending <br /> subsection (b) to read as follows: <br /> "(b) The council shall appoint the county clerk [ .. . - - <br /> from civil service laws and classifications]. The county clerk shall: <br /> (1) Be the clerk of the council. <br /> (2) Be custodian of the county seal. <br /> (3) Conduct all elections held within the county. <br /> (4) Appoint the deputy county clerk, with the approval of the council [ <br /> elessifeations]. <br /> (5) Perform such other functions as the council may prescribe. <br /> (6) Appoint necessary staff for which appropriations have been made by the <br /> council [, subject to civil service laws and classifications,] and exercise <br /> the same power with respect to the personnel of the clerk's office as the <br /> department heads in the executive branch, with the exception of the <br /> office of the legislative auditor." <br /> Section 2. Article IV, section 4 -5, Hawaii County Charter, is amended to read as <br /> follows: <br /> "Section 4 -5. Powers and Duties of Agency Heads. <br /> Subject to the provisions of this charter, the administrative heads of each agency <br /> or executive agency of the county shall have the power to: <br /> (a) Appoint and remove a deputy or assistant and a private secretary [and such <br /> such appointment shall be made unless the positions have been created and <br /> appropriations therefor have been made by the council. <br /> (b) Appoint necessary staff for which appropriations have been made by the <br /> council. <br /> • 11 <br />
