AN ORDINANCE AMENDING BOTH CHAPTER 2, ARTICLE 9, DEPARTMENT OF PUBLIC WORKS AND CHAPTER 2, ARTICLE 14, MASS TRANSIT AGENCY OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), BY DELETING SECTION 41(5), CHAPTER 2, ARTICLE 9, AND BY ADDING SIMILAR LANGUAGE TO CHAPTER 2, ARTICLE 14, SECTION 76 -78, AS WELL AS CHANGING THE NAME OF THE MASS TRANSIT AGENCY TO THE TRANSPORTATION AGENCY. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. The purpose of this measure is to amend Chapter 2, Article 14, of the Hawaii County Code, by changing the name of the Mass Transit Agency, to the Transportation Agency, to reflect the assumption of the County of Hawai'i's Automotive Division duties and responsibilities, currently held within the County of Hawai'i's Department of Public Works. SECTION 2. Chapter 2, Article 9, Section 41, of the Hawaii County Code 1983 (2005 Edition, as amended), is amended to read as follows: Section 2 - 41. Divisions within department. The department of public works shall be divided under the director into the following divisions: (1) Engineering Division. The engineering division is responsible for coordinating the planning, engineering, and implementation of the highway and drainage capital improvement projects, coordinating 'all land surveying, conducting necessary land rights acquisition, and providing construction inspectional services. (2) Traffic Division. The traffic division determines the location, installs, maintains, and repairs all traffic control facilities and devices and street lighting systems; is responsible for all traffic engineering in the County; maintains a traffic education program; and is responsible for the installation, maintenance, and repair of on- and off - street parking meters. •
