I. �J N S O \ \��,.. <br /> COUNTY OF HAWAII ' _ • I STATE OF HAWAII <br /> • <br /> �l Hi M? • r� . <br /> • ,T EOiNT'�" <br /> RESOLUTION NO. 382 10 <br /> RESOLUTION ACCEPTING THE GRANT OF EASEMENT FROM KAILUA KONA <br /> VILLAGE DEVELOPMENT GROUP, LLC FOR TRAFFIC SIGNAL LIGHT POLE <br /> PURPOSES. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. <br /> WHEREAS, KAILUA KONA VILLAGE DEVELOPMENT GROUP, LLC is the owner <br /> of Tax Map Key: (3)7 -5- 007:021, situated in Kailua, District of North Kona, County and State of <br /> Hawaii; and <br /> WHEREAS, the County of Hawai`i would like to install a traffic signal at the corner of <br /> Ali`i Drive and Hualalai Road; and <br /> WHEREAS, Kailua Kona Village Development Group, LLC is desirous of granting the <br /> County of Hawai`i an easement, which easement is more particularly delineated on Exhibit "A" <br /> attached hereto as Easement 4; and <br /> WHEREAS, Article XIII, Section 13 -12 of the Hawai`i County Charter, provides that the <br /> Council, on behalf of the County of Hawai`i, may accept gifts or donations of money, securities <br /> or other personal property or of real estate or any interest in real estate. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF <br /> HAWAII, in accordance with Article XIII, Section 13 -12 of the Hawai`i County Charter, the <br /> County of Hawai`i accepts the grant of Easement 4 delineated on Exhibit "A" attached hereto, <br /> from Kailua Kona Village Development Group, LLC. <br /> BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (1) Mayor <br /> William P. Kenoi; (2) Director of Public Works Warren H.W. Lee; (3) Deputy Corporation <br /> Counsel Gerald Takase; and (4) William J. Kimi, Jr., Manager, Kailua Kona Village <br /> Development Group, LLC, 75 -5744 Ali`i Drive, Suite 286, Kailua -Kona, Hawai`i 96740. <br /> -1- <br />
