No. 664.7/Bill 194, Draft 2 <br /> PLACE: Sheraton Keauhou Bay Resort & Spa <br /> 78 -128 Ehukai Street <br /> Kailua -Kona, Hawaii <br /> TIME: 2:00 p.m. <br /> Council Chair and Members <br /> Hawaa'i County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Planning, to which was referred Bill No. 194, Draft 2, reports as follows <br /> Bill No. 194, Draft 2, transmitted via Communication No 664.7 from Council Chair J Yoshimoto, dated <br /> August 3, 2010 provides for amendments as previously suggested by former Planning Director Chris <br /> Yuen and by Council Member Emily Naeole in July 2008, as well as non - substantive amendments <br /> correcting the spelling of certain Hawaiian words and typographical errors. <br /> This matter was referred to the Planning Director in January 2010 for review and comment. It was <br /> referred back to your Committee, but in the August 8, 2010, meeting Council Member Dominic Yagong <br /> moved to take the matter to a public hearing. Council Members Brenda Ford and Pete Hoffmann also <br /> voted in favor of the public hearing. <br /> The public hearing was held in the Kea'au Middle School cafeteria on August 30, 2010. Of the 65 <br /> members of the public who testified at the hearing, 17 were opposed to the amendments, 39 spoke in <br /> favor of the amendments, one was opposed to the plan but in support of the amendments, and eight <br /> provided comments only <br /> At the September 20, 2010 meeting, testimony was provided by four members of the public. Three spoke <br /> in favor of the amendments, one was opposed. <br /> Planning Committee Vice -Chair Guy Ennques remained seated as Chair of the meeting, in order to allow <br /> Committee Chair Donald Ikeda to participate in the discussion of this matter. <br /> Some of your Committee members expressed concern that no one from the Puna CDP Action Committee <br /> was present at the meeting. Director Leithead -Todd reminded your Committee that a communication <br /> from the Action Committee, stating the Action Committee's comments and recommendations, was <br /> distributed to each Committee member quite some time back Council Member Brenda Ford stated that <br /> she agreed with the Action Committee that weaker words give the Planning Department too much <br /> discretion. Council Chair J Yoshimoto stated that he was willing to prepare a Draft 3, strengthening the <br /> action words if necessary.
