+ tw os <br /> COUNTY OF HAWAII `''�� �" � * STATE OF HAWAII <br /> RESOLUTION NO. 396 10 <br /> RESOLUTION ACCEPTING THE GRANT OF EASEMENT AND BILL OF SALE FOR <br /> WASTEWATER TREATMENT PLANT FACILITIES, COLLECTION SYSTEM AND <br /> APPURTENANCES, AT HAINA, DISTRICT OF HAMAKUA, ISLAND, COUNTY AND <br /> STATE OF HAWAII, FROM HAWAII HEALTH SYSTEMS CORPORATION AND EAST <br /> HAWAII REGIONAL HEALTH CARE SYSTEM/REGIONAL SYSTEM IV, AFFECTING <br /> TAX MAP KEYS: (3)4 -5- 002 -060, 4 -5- 002 -011, 4 -5- 002 -012, 4 -5- 002 -021, 4 -5- 002 -035, <br /> 4 -5- 002 - 044,4 -5- 002 -050, 4 -5- 002 -061, 4 -5- 002 - 063,4 -5- 002 -071, 4 -5- 002 -072, 4 -5- 002 -074, <br /> 4 -5- 002 -075, 4 -5- 002 -081, AND 4 -5- 023 -071, TO THE COUNTY OF HAWAII. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. <br /> WHEREAS, Hawaii Health Systems Corporation and East Hawaii Regional Health Care <br /> System/Regional System IV are the owners of the sewer facilities located on Tax Map <br /> Key: (3)4 -5- 002 -060 and the sewer lines that constitute the underground wastewater collection <br /> system which currently serves the wastewater treatment plant on Parcel 60 (see Exhibit A <br /> attached hereto); and <br /> WHEREAS, the County of Hawai`i needs the grant of easement and bill of sale to install, <br /> refurbish, upgrade, expand, operate and maintain, the underground wastewater collection system <br /> and all other related facilities now owned by Hawaii Health System Corporation and East Hawaii <br /> Regional Health Care System/Regional System IV related to the sewer facilities on Tax Map <br /> Key:(3)4 -5- 002 -060 (see Exhibit B attached hereto); and <br /> WHEREAS, the underground wastewater collection system has been inspected and found <br /> to be in acceptable condition and is in compliance with the provisions of Chapter 21 of the <br /> Hawai`i County Code; and <br /> WHEREAS, Article XIII, Section 13 -12 of the Hawai`i County Charter, provides that the <br /> Council may accept gifts of donations of money, securities or other personal property or of real <br /> estate, or any interest, in real estate, on behalf of the County of Hawaii; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF <br /> HAWAII, in accordance with Article XIII, Section 13 -12 of the Hawai`i County Charter, and <br /> Chapter 21 of the Hawai`i County Code, that the County of Hawai`i accepts the grant of <br /> perpetual easement and bill of sale for all portions of the wastewater treatment plant facilities, <br />
