LEEWARD PLANNING COMMISSION <br /> COUNTY OF HAWAI`I <br /> HEARING TRANSCRIPT <br /> AUGUST 27, 2010 <br /> A regularly advertised hearing on the PLANNING DIRECTOR INITIATED AMENDMENT <br /> TO CHAPTER 25, FILING FEE FOR USE PERMIT was called to order at 10:34 a.m. in the <br /> King Kamehameha's Kona Beach Hotel, Ballroom I, 75 -5660 Palani Road, Kailua -Kona, <br /> Hawai`i, with Chairman Frederic Housel presiding. <br /> COMMISSIONERS PRESENT: Frederic Housel, Brandi Beaudet, Lani Bowman, Geraldine <br /> Giffin, Thomas Hickcox, Wayne Iokepa and Richard Nelson <br /> STAFF PRESENT: Brandon Gonzalez (Deputy Corporation Counsel), BJ Leithead Todd <br /> (Planning Director), Margaret Masunaga (Deputy Planning Director), Daryn Arai (Planning <br /> Program Manager), Jeff Darrow (Staff Planner) and Maija Cottle (Staff Planner) <br /> And approximately 60 people from the public in attendance. <br /> INITIATOR: PLANNING DIRECTOR <br /> Amendment to Chapter 25 (Zoning Code), Hawaii County Code 1983 (2005 Edition, as <br /> amended) relating to Filing Fee for a Use Permit Application. <br /> HOUSEL: We have Item No. 3. This is, the initiator is the Planning Director. This is an <br /> amendment to Chapter 25, Zoning Code, Hawai`i County Code 1983 (2005 Edition, as amended) <br /> relating to the filing fee for use permit application. Daryn, would you like to provide the <br /> information? <br /> ARAI: Thank you, Mr. Chairman. Good morning, Commissioners. The Commission may <br /> recall that on March 5, 2010, the Leeward and Windward Planning Commissions supported to <br /> adopt the Rules of Practice and Procedure, portion of which amended Rule No. 7 regarding use <br /> permits to allow an increase in the filing fee from $250 to $500. The bill before you is a <br /> proposal to amend the Zoning Code in order to allow for an increase in the filing fee from $250 <br /> to $500 consistent with the Rules of Practice and Procedure that was previously adopted by the <br /> Planning Commission. So we have before you the draft bill with our favorable response. <br /> HOUSEL: I'm sorry. Did you read the entire clause or do you intend to? <br /> ARAI: You mean as far as the proposed amendment? Well, the draft bill is before you as part of <br /> your background report, and it indicates where the Section 25 -2 -62 of the Zoning Code, <br /> Subsection (b) (1), "A filing fee of $250" — the number "$250" will be struck out and replaced <br /> with $500. <br /> HOUSEL: Any questions, Commissioners, to the staff?
