WHEREAS, these conditions often lead to situations where multiple vehicles must <br /> reverse or completely leave the roadway to allow passage; and <br /> WHEREAS, this segment of Old Volcano Trail is one of only two access routes to <br /> State Highway 11 servicing the very large settlement area of Hawaiian Acres; and <br /> WHEREAS, the narrowness of this segment of Old Volcano Trail is the primary cause <br /> of traffic gridlock at South Kulani Road; and <br /> WHEREAS, the lack of any alternate routes elevates this gridlock situation to an urgent <br /> matter of public safety for both the Hawaiian Acres and Fern Acres subdivisions; and <br /> WHEREAS, the Department of Public Works has acknowledged the increase in traffic <br /> loads, largely due to increased population in this area, and has recently paved and improved the <br /> County portion of South Kulani Road; and <br /> WHEREAS, the Department of Land and Natural Resources has initiated research for <br /> issuance of a permit for the Department of Public Works to effect improvements to widen and <br /> resurface this portion of Old Volcano Trail; and <br /> WHEREAS, pursuant to Hawai`i Revised Statues, section 46 -7, the Council may consent <br /> to agreements between the County and the State government respecting action to be taken <br /> pursuant to the powers granted to the County by law and to furnish, expend, and receive any <br /> funds or other assistance in connection with projects to be undertaken by the County; now, <br /> therefore: <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in <br /> accordance with section 46 -7, Hawai`i Revised Statutes, the Mayor of the County of Hawaii is <br /> hereby authorized to enter into and execute on behalf of the County a memorandum of <br /> agreement with the State of Hawai`i for execution of Old Volcano Trail improvements. <br /> 2 <br />
