JUSTIFICATION SHEET <br />PROPOSER: Hawaii State Association of Counties (HSAC) <br />TITLE: A BILL FOR AN ACT RELATING TO NOMINATION PAPERS <br />PURPOSE: The purpose of the draft bill is to require that candidates for <br />elective county office include with their nomination paper a sworn <br />certification of compliance with any relevant provision of the <br />county charter or ordinances pertaining to elected officials, or the <br />nomination papers shall be void and not accepted for filing by the <br />county clerk. <br />MEANS: Amend Section 12 -3, Hawaii Revised Statutes, to add to the list of <br />information required to be contained in a candidate's nomination <br />paper the following: <br />"For candidates seeking elective County office, a sworn <br />certification by self - subscribing oath by the candidate that the <br />candidate has complied with provisions of the relevant County <br />charter and County ordinances pertaining to elected officials." <br />JUSTIFICATION: This measure will help to ensure that a candidate for elective <br />County office has complied with any County laws, including the <br />filing of financial disclosure statements, prior to the candidate's <br />name being placed on the ballot. <br />
