STATE OF HAWAII <br /> er • bF <br /> RESOLUTION NO. 410 10 <br /> RESOLUTION AUTHORIZING THE COUNTY OF HAWAII TO ENTER INTO A <br /> MULTI -YEAR LICENSE AGREEMENT OF REAL PROPERTY FOR THE CONTINUED <br /> USE OF A PUBLIC SAFETY RADIO TOWER SITUATED ON A PORTION OF STATE OF <br /> HAWAII DEPARTMENT OF HAWAIIAN HOMES LANDS IN HUMUULA, NORTH <br /> HILO, HAWAII, TAX MAP KEYS: (3) 3 -8- 001 -007 AND 015. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. <br /> WHEREAS, Section 10 -11 of the Hawai`i County Charter requires that any contract, <br /> lease or other obligation requiring payment of funds from the appropriations of a later fiscal year <br /> or of more than one fiscal year shall be approved by resolution; and <br /> WHEREAS, the County of Hawai`i Fire Department has determined that there is an <br /> immediate and pressing need for continued operations and maintenance of its voice, data and <br /> control communications mobile radio relay antennae facility located on property owned by the <br /> State of Hawai`i Department of Hawaiian Homes Lands; and <br /> WHEREAS, the County administration wishes to enter into a twenty -one (21) year <br /> license agreement, commencing retroactively as of August 1, 2008 and terminating on July 31, <br /> 2029, with the State of Hawai`i Department of Hawaiian Homes Lands, for the use of the parcels <br /> identified as Tax Map Keys: (3) 3 -8- 001:007 and 015, situated on a portion of Humu'ula, North <br /> Hilo, Hawai`i, for continued operations and maintenance of its voice, data and control <br /> communications mobile radio relay antennae facility, at the following rental: <br /> Period: Annum Payment: Monthly Payment: <br /> Year 1 $15,000.00 One -time payment <br /> Year 2 $15,900.00 of $30,900.00 <br /> Years 3 -6 $11,928.00 $944.00 <br /> Years 7 -12 $12,636.00 $1,053.00 <br /> Years 12 -16 $14,292.00 $1,191.00 <br /> Years 17 -21 $15,156.00 $1,263.00 <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY <br /> OF HAWAII that (1) the Mayor is hereby authorized to enter into a multi -year license <br /> agreement for the continued operations and maintenance of its voice, data and control <br /> communications mobile radio relay antennae facility as described herein, pursuant to <br />
