. f <br /> The Honorable J Yoshimoto, Chairman <br /> and Members of the County Council <br /> Page 4 <br /> hotels, multi - family residential, single- family residential, public facilities and commercial <br /> uses, is located proximate to the site. Water can be made available to the site. Police and <br /> fire protective services are within close proximity to the project site. All essential <br /> utilities will be made available to the property. <br /> The property has no severe geological or topographical problems which <br /> cannot be properly rectified or which would render the land unusable. According to <br /> the Department of Public Works, Flood Zone "AE" affects the subject parcel in a north to <br /> southwest direction. Thus, any improvements to the property must comply with Chapter <br /> 27 of the County Code relating to Flood Plain Management. As the project is required to <br /> comply with Chapter 27, the reclassification meets the standard which states that the <br /> lands included within the urban district "... shall be those with satisfactory topography <br /> and drainage and reasonably free from the danger of floods, tsunami and unstable soil <br /> conditions and other adverse environmental effects." <br /> While the project site is situated within the State Land Use Agricultural and <br /> County's Agricultural (A -5a) zoned district, it is not currently being used for active <br /> agricultural purposes. The property is unclassified under the State of Hawai`i's <br /> Agricultural Lands of Importance to the State of Hawai`i (ALISH) Map and is not in <br /> agricultural use. The project site is vacant. The Land Use Study Bureau's Overall Master <br /> Productivity Rating for the soils in the area is "D" or "Poor ". <br /> An Inventory Survey for 29.389 Acres in Kahului 2 North Kona District, Island <br /> of Hawai`i dated April 2008 was prepared by Escott, Wolforth, and Wilson (Appendix B <br /> in application). Twenty archaeological sites were discovered on the site and evaluated <br /> with no further work recommended. <br /> The reclassification of 14.707 acres from the Agricultural to the Urban <br /> designation will not be detrimental to the reduction of this area from the agricultural land <br /> inventory in the County of Hawai`i. Based on the above, the approval of the State Land <br /> Use Boundary Amendment from the Agricultural to the Urban District complements the <br /> State Land Use District Regulations and is supportive of the Hawai`i State Plan. <br /> Change of Zone <br /> The applicant is requesting a Change of Zone from Agricultural (A -5a) to Single - <br /> Family Residential (RS -7.5) to develop a 46 -lot single - family residential subdivision with <br /> lots that are approximately 7,500 square feet in size. The applicant is also requesting a <br /> concurrent processing of a State Land Use Boundary Amendment from Agricultural to <br /> Urban. <br /> The primary factor for this unfavorable recommendation is based on non- <br /> compliance with the requirements of the Kona Community Development Plan for <br /> projects located within a transit - oriented development (TOD), which will be explained in <br />
