Section 14 - . Penalty. <br />(a) Any business that violates the provisions of this article shall be sentenced <br />to pay a fine not exceeding $100 for the first violation and up to $500 for a <br />third violation within a single year. <br />(b) Any business that violates the provisions of this article shall be required to <br />remove all plastic checkout bags from its premises and shall be liable for <br />any associated costs. <br />(c) Each day of violation shall constitute a separate offense. <br />(d) Fines collected pursuant to this article shall be deposited into the public <br />access, open space, and natural resources fund, as authorized by Hawaii <br />County Code section 2- 214(b)(3)." <br />SECTION 3. Severability. If any provision of this ordinance or the application thereof <br />to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or <br />applications of the ordinance which can be given effect without the invalid provision or <br />application, and to this end, the provisions of this ordinance are declared to be severable. <br />SECTION 4.
