WHEREAS, the high equipment and operations start-up costs, estimated at between $1,500,000 and <br />$2,000,000, require a multi -year commitment to enable , a contractor to recover cost's and secure reasonable terms <br />for equipment financing; and <br />WHEREAS, a multi -year commitment also provides the County the most favorable opportunity for <br />competitive bids; and <br />WHEREAS, it is in the County's best interest to contract the operation of organic waste diversion sites <br />based on a ten (10) year agreement and provide for two (2) option periods of up to five years each to extend the <br />contracted services; and <br />WHEREAS, Article X, Section 10 -11 of the County Charter requires that any contract, lease or other <br />obligation requiring payment of funds from the appropriations of a later fiscal year or more than one fiscal year <br />be approved by resolution. <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that in accordance with <br />Article X, Section 10 -11 of the Hawaii County Charter, the Mayor is hereby authorized to enter into a multi- <br />year contract for services of furnishing and implementing organic waste diversion sites and compost operations <br />in West Hawaii and East Hawaii for the Department of Environmental Management and that sufficient funds <br />be budgeted in future fiscal years to cover the anticipated obligation of the County under the terms of the <br />agreement. <br />BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this resolution to the <br />Mayor, the Director of Environmental Management and the Director of Finance. <br />Dated at , Hawai'i, this day of , 2011. <br />INTRODUCED BY: <br />COUNCIL MEMBER, COUNTY OF HAWAII <br />COUNTY COUNCIL <br />County of Hawai'i <br />Hilo, Hawai'i <br />I hereby certify that the foregoing RESOLUTION was by <br />The vote indicated to the right hereof adopted by the COUNCIL of the <br />County of Hawaii on <br />ATTEST: <br />ROLL CALL VOTE <br />Reference: C— 86/ FC <br />COUNTY CLERK CHAIRPERSON & PRESIDING OFFICER RESOLUTION NO. 34 11 <br />AYES <br />NOES <br />ABS <br />EX <br />BLAS <br />FORD <br />HOFFMANN <br />IKEDA <br />ONISHI <br />PILAGO <br />SMART <br />YAGONG <br />YOSHIMOTO <br />Reference: C— 86/ FC <br />COUNTY CLERK CHAIRPERSON & PRESIDING OFFICER RESOLUTION NO. 34 11 <br />
