COUNTY OF HAWAII <br />ORDINANCE NO. <br />STATE OF HAWAII <br />BILL NO. 32 <br />AN ORDINANCE AMENDING CHAPTER 7 OF THE HAWAII COUNTY CODE 1983 <br />(2005 EDITION), RELATING TO CIVIL DEFENSE, DISASTER CONTROL. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br />SECTION 1. The purpose of this measure is to prohibit persons from <br />parking in disaster areas. <br />SECTION 2. Chapter 7, Article 2, of the Hawai'i County Code 1983 (2005 <br />edition), relating to Civil Defense, Disaster Control, is amended by adding a new <br />section to read as follows: <br />Section 7- 12. Parking in designated area prohibited. <br />a) Except when authorized by an authorized person or specific traffic control device, no <br />person shall stop, stand or park a vehicle within an impending disaster or disaster area <br />as described in a Mayor's and /or Governor's emergency declaration. <br />b) Any person found guilty of violating this section shall be guilty of a violation and subject <br />to a fine not exceeding $35 and the vehicle towed and stored at the owners expense <br />for each separate offense. <br />SECTION 3. New material is underscored. In printing this ordinance, the <br />underscoring need not be included. <br />SECTION 4. Severability. If any provision of this ordinance, or the <br />application thereof to any person or circumstance, is held invalid, such invalidity shall <br />not affect other provisions or applications of the ordinance which can be given effect <br />without the invalid provision or application, and to this end, the provisions of this <br />ordinance are declared to be severable. <br />SECTION 5.
