Pursuant to Hawaii County Code (HCC) Sec. 3- 22(a), I am forwarding Coldwell Banker
Maryl Realty's completed application for a sign variance. The owner of the property is
A.R.B.P. LLC. and the applicant is Bud Norwood whose phone number is (808)331-
3244. The applicant is requesting a sign variance for a wall sign. The proposed sign is
42.65sf. in area with an 11 inch symbol. The maximum allowable letter and /or symbol is
nine inches per section 3 -58 (c) chapter three Hawaii County Code. The business is
located in CG -20 zone which limits the wall sign to nine feet in height per section 3-
59(a)(4) chapter three Hawaii County Code.

Coldwell Banker Maryl Realty — Sign Variance Request
To Whom It May Concern:
We respectfully submit the attached request for a sign variance for a Coldwell Banker Maryl Realty sign that will
be installed above the Borders Books Music and Cafe sign located at 75 -1000 Henry Street, on the corner of
Queen Kaahumanu Highway and Henry Street.
Our request is for a variance from the standard maximum of a 9" sign in the Kailua Village District to an 11"
sign. The specifications of that request are included in our sign variance application and attached documents.
Coldwell Banker LL.C, has certain requirements for exterior building signage which must be adhered to, as noted
herewith:
Requirements: The building signs must maintain a 50140 configuration ratio between the words "Coldwell
Banker "and your company name regardless of the final size of the individual letters. The point size of your
company name is to be 60% of the point size of the Coldwell Banker letters, with the exception of one word
company names of eight characters or less, which should use 70% of the Coldwell Banker letters for the
.stacked logo format and 80% for the extended logo format. Your company name should be centered.
Required Disclaimer. The Minimum Required Disclaimer line must appear centered below the company name.
Based on these requirements, the previous approvals given to Border's Books and Music for a sign variance, and
the desire to be have a sign that is easily visible from the street, we are requesting a variance.
In addition to the required documentation for a sign variance request, we have also enclosed for your
consideration, a copy of our lease agreement and attached exhibits and photo, signed by the owner of the
building, approving the size, specifications and location of the proposed Coldwell Banker Maryl Realty sign.

SUBLEASE AGREEMENT
THIS SUBLEASE ( "Lease ") is made as of September Aq , 2009 by and between
A.R.B.P., LLC, a Delaware limited liability company ( "Landlord "), and Maryl Realty,
Inc., a Hawaiian corporation, ( "Tenant ").
THE PARTIES COVENANT AND AGREE AS FOLLOWS:
I. 1 SPECIAL LEASE PROVISIONS
A. Leased Premises Approximately 1,875 square feet, more or less,
identified as Suite No. 203 (the "Premises ") as shown on Exhibit A -2 attached hereto in
the building at 1000 Henry Street, located on Lot 1 of the Crossroads subdivision, District
of North Kona, County and State of Hawaii, Tax Map Key (3) 7 -5- 004:058 (Lot 1 and the
improvements thereon are shown on Exhibit A -1 hereto and shall hereafter collectively
be called the "Property "). This Lease is a sublease subject to that certain Indenture of
Lease dated November 10, 1994, made by and between CLARENCE STANLEY
RAPOZA, JULIE ANN VILORIA and BARBARA JUNE BOHNENKAMP, as Lessor, and
Landlord's predecessor, as Lessee, a Short Form of which, dated November 4, 1994, is
recorded in the Bureau of Conveyances of the State of Hawaii as Document No. 94-
202007, as amended from time to time, herein referred to in this Lease as "the Master
Lease ". If there is any conflict between the provisions of this Lease and the provisions
of the Master Lease, the Master Lease shall control. Tenant covenants and agrees that
it will not violate any term, covenant or condition contained in the Master Lease and on
the part of Landlord to be observed and performed.
B. Leasehold Improvements

C. Term
Term. Unless sooner terminated as provided herein, the term of this
Lease shall be for 36 months commencing on August 1, 2010 ( "Commencement Date ")
and ending on July 31, 2013 (the "Termination Date ").
Tenant shall have one option to extend the term of this Lease for a period
of 2 years at the then prevailing rental rate, as detailed in paragraph 37.

D. Rent And Other Charges
1. Monthly Base Rent Commencing on the Commencement Date and
continuing for the first 24 months of the term of this Lease, the Monthly Base Rent shall
be $. The Monthly Base Rent for the remaining 12 months of the term of this
Lease shall be $�
2. Tenant's Percentage of Property Expenses and Utility Charges
6.1305 ( "Tenant's Share "). During the entire term of this Lease, including the
Escalation Period, if any, Tenant shall pay monthly, as additional rent, Tenant's Share
of the "Property Maintenance And Operating Expenses" and utility charges not
separately metered (presently estimated at $ 0.81 per square foot per month). Tenant's
Share shall be in the amount stated above and is not dependent on the actual square
footage of the Premises or of the Property.
3. Tax on Payments Tenant shall pay Landlord an additional 4.166
of the Monthly Base Rent, and "Tenant's Percentage of Property Expenses and Utility
Charges ", as additional rent and other payments to Landlord for Landlord's general
excise tax as provided in Paragraph 9 of the Standard Terms and Provisions.
E. Tenant's Permitted Use Tenant shall use the Premises for a
professional office and no other purpose as provided in Paragraph 12 of the Standard
Terms and Provisions.
F. Tenant Parking Tenant shall have 5 assigned parking spaces within the
Property, subject to Paragraph 10 of the Standard Terms and Provisions.
G. Security Deposit Waived.
H. Payments Tenant shall make all payments required under this Lease to
A.R.B.C, LLC., c/o Pacifica Realty Management, Inc. 75 -1029 Henry Street, Suite 202,
Kailua Kona, HI 96740 or such other address as Landlord may, from time to time,
designate to Tenant in writing.
J. Agreement This Lease, which consists of these Special Lease
Provisions, the attached Standard Terms and Provisions, and the attached (check as
applicable):

§ 3 -58 HAWAII COUNTY CODE
(5) Wall sign.
(A) If lot frontage is up to thirty lineal feet, a wall sign shall not exceed fifteen percent of the total
exposed area of the wall, associated with the business on which the sign is displayed, or
twelve square feet, whichever is less. A sign on the face of the building for each business
conducted on the premises shall not exceed fifteen percent of the area of the face of the
building actually occupied by the business, or twelve square feet, whichever is less.
(B) If lot frontage is greater than thirty lineal feet, a wall sign shall not exceed fifteen percent of
the total exposed area of the wall, associated with the business for which the sign is displayed,
or twenty -two square feet, whichever is less. A sign on the face of the building for each
business conducted on the premises shall not, exceed fifteen percent of the area of the face of
the building actually occupied by the business or twenty -two square feet, whichever is less.
(C) In the Kailua Industrial Subdivision, the maximum wall sign area shall not exceed seventy -
five square feet or fifteen percent of the wall, whichever is less.
(D) The total area of any wall covered by signage shall not exceed fifteen percent of the total area
of the wall on which it is located, whether used by single or multiple businesses.
(6) Window signs and painted window signs.
(A) For any business, the total area allowed to be covered by one or more window signs fronting
any street shall be no more than fifteen percent of the total combined area of windows or
twenty -two square feet, whichever is less.
(b) In any case, the total area allowed shall not exceed twelve square feet for any sign not fronting a public
street or vehicular access or for any sign located within the Kailua Village Core.
(c) Any lettering or symbol, including free - standing letters, shall not exceed nine inches in height, except as
noted in (1) below.
(1) In the Kailua Industrial Subdivision, any lettering or symbol, including free - standing letters, shall
not exceed eighteen inches in height.
(2005, Ord. No. 05 -62, sec. 3.)
Section 3 -59. Sign elevation.
(a) Maximum sign elevation, measured from the finished ground elevation to the top of the sign, shall be as
follows:
(1) Directory wall sign. A directory wall sign shall not exceed nine feet in elevation.
(2) Ground sign. The elevation of a ground sign shall be computed as the distance from the base of the
sign at normal grade to the top of the highest attached component of the sign. Normal grade shall
be construed to be the lower of either the existing grade prior to construction or the newly
established grade after construction, exclusive of any filling, berming, mounding, or excavating
solely for the purpose of locating the sign. A ground sign shall not exceed six feet in elevation. The
lettering or symbols shall not be higher than five and one -half feet from the finished elevation.
(3) Projecting sign. A projecting sign may be placed no less than nine feet above ground, and may
extend into no more than one -third of the width of any public area or pedestrian way, or four feet,
whichever is less.
(4) Wall sign. The top edge of a wall sign shall not exceed nine feet above the grade or finished floor
level or one -half the height of the wall on which it is located, whichever is less.
(5) Window sign. A window sign shall not exceed five and one -half feet in height.

The Kailua Village Design Commission (KVDC) discussed the sign proposal, and recognized that
the proposed sign, as reported by the Department of Public Works (DPW), is larger, and the letter
height exceeds the limit allowed by the Sign Code (Hawaii County Code, Chapter 3) and will require
a variance. The KVDC recognizes that the DPW is responsible for administering and enforcing the
sign code and will be responsible for processing a sign variance application which ultimately will
require Hawaii County Council approval.
The Design Commission voted to recommend to the Public Works Director the approval of the sign
which will require a variance as submitted.

To Whom It May Concern:
We respectfully submit the attached request for a sign variance for a Coldwell Banker Maryl
Realty sign that will be installed above the Borders Books Music and Cafe sign located at 75 -1000
Henry Street, on the corner of Queen Kaahumanu Highway and Henry Street.
Our request is for a variance from Hawaii County Code Section 3 -58 (a) (5) (B) that states that a
wall sign should not exceed twenty two square feet and from Hawaii County Code Section3 -58
(a) (6) (c) that states any lettering or symbol, including free - standing letters, shall not exceed
nine inches in height.
In regards to the explanation of why granting the variance will not adversely affect
the rights of adjacent property owners or tenants, we are requesting a variance in
the size of lettering of only two inches, from the allowed nine inches in height to
eleven inches in height.
1) The Border's Books and Music sign currently on this building was previously given
sign variance approval for 42" letters with a square footage of approximately 169
sq.ft. (see attached Border's sign specifications)
2) Coldwell Banker Maryl Realty is requesting a variance approval for 2" over the
allowed 9" letters with a square footage of only approximately 43 sq.ft.
3) Coldwell Banker Maryl Realty has complied with Section 3 -22 (9) by notifying all
owners and tenants within 300' of the building and have received no negative

Variance to install a sign on the Border's Books & Music building located at 75 -1000 Henry Street,
Kailua Kona, Hawaii (TMK: 3- 7- 5- 4 -58). This variance is to request certain deviations from the
requirements specified by the Hawaii County Sign Code (Chapter 3):
Chapter 3 -58 (5) (8):
If lot frontage is greater than thirty lineal feet, a wall sign shall not exceed fifteen percent of the
total exposed area of the wall, associated with the business for which the sign is displayed, or
twenty -two square feet, whichever is less A sign on the face of the building for each business
conducted on the premises shall not exceed fifteen percent of the area of the face of the building
actually occupied by the business or twenty-two square feet, whichever is less
Chapter 3 -58 (6) (C):
Any lettering or symbol, including free standing letters, shall not exceed nine inches in height,
except as noted in (1) below.
(1) In the Railua Industrial Subdivision, any lettering or symbol, including free standing letters,
shall not exceed eighteen inches in height.

Henry Street and WalMart. On the Mauka side is Lowes and some vacant commercial
lots.
