TESTIMONY IN COMMENT to Res. 32-11: AUTHORIZES THE
ACCEPTANCE OF A MONETARY DONATION OF $500 TO THE
HAWAI' I COUNTY POLICE DEPARTMENT FOR THE PURCHASE OF
MATERIALS TO EDUCATE THE PUBLIC AGAINST
METHAMPHETAMINE DRUGS, as identified on the Agenda of the
County Council, County of Hawaii for the Wednesday, March 2, 2041
meeting. 18 U.S.C. §4. Misprision of felony to violations of 18 U.S.C. §3
Accessory after the fact to violations of the Federal RICO Act, 18 U.S.C.
§ 1961. "racketeering activity ", Extortion, Dealing in a controlled substance,
18 U.S.C. § 1512 Tampering with a witness, victim, or an informant, 18
U.S.C. § 1513 Retaliating against a witness, victim, or an informant.
Aloha Council Members,
The attached nineteen, (19), pages of documentation identifies an INDIRECT
CONFESSION by Hawaii County Police, Sworn Officials of the County of Hawaii, et.
al., via the Legal Doctrine of Assenting- Silence to knowing and knowingly violations of
United States Code Title 18, Section 3, Accessory after the fact to acts and actions of the
Hawaii County Police Department's involvement in "racketeering activity ", Extortion;
Dealing in a controlled substance; Threatening a witness and victim, or an informant; and
Retaliating against a witness, victim, or an informant against a person reporting to Police
Officers of the County of Hawaii, as required by 18 U.S.C. §4 Misprision of felony,
where such reports contained verifying photographic evidence of organized drug
operations in the Puna District of the Island of Hawaii. Where Police Officers, with the
timely and personal knowledge of Hawaii County Police Chief Harry Kubojiri, did assist
persons dealing in a controlled substance by hindering or preventing their apprehension,
trial or punishment as an accessory after the fact, and as Principals for aiding and abetting
by providing Police protection to organized drug operations on the Island of Hawaii.
Therefore the donated funds by the Hawaii Police Athletic Foundation for the
purchase of materials such as brochures and pamphlets for a Hawaii County Police
Department specified public education project would seem disingenuous on the part of
the Hawaii County Police Department due to the attached information.

The attached documentation, in addition to the documentation on file in the
Hawaii County Clerk's Repository of Records, State and Federal Court records, and/or
documented as received correspondence that was presented to you m fulfillment of a
persons obligation under 18 U.S.C. §4. As of this date I have not received, as requested,
a confirmation of fufllment of a persons obligations to make known the actual
commission of a felony to a civil authority under the United States as required by 18
U.S.C. §4 Misprision of felony.
If you believe that you have fulfilled you Sworn Oath of Office obligations, or if
you dispute that you are obligated in any way by your Oath of Office to take action on the
information and/or actual knowledge of felonies as cognizable by a Court of the United
States made known to you m your Official Positions, you are required to present me your
confirmation of your fulfillment of the obligations required by 18 U.S.C. §4, or your
disputes that you have any legal obligations to do same on or before 15 February 2011,
your responses, if any, will be included as EXHIBITS to the COMPLAINT filed

Subject: New Organized Drug Operation Starting in HPP
Aloha Chief,
I have noticed over the past 5 days a pattern of Boom Box Music
being played for about 1/2 minute every 1/2 hour, on the hour or 15
minutes past the hour, which indicates from many years of experience a
known pattern and history of organized drug operations in the Hawaiian
Paradise Park area. Drug Houses use a particular Boom Music song to
identify themselves to potential customers and that they are open for
business, the fact that the Boom Music is playing indicates that there are
no, "Non- Corrupt" police in the area. In the past I have noticed that
certain variations of the Boom Music will result in a car or motorcycle
appear in front of a suspected drug house with stopping only for a few
seconds to hand something to someone on the property.
Chief, you are extremely familiar with my expertize in identifying such
Drug activity and that it is my belief based upon personal experience,
and observations, that you are involved in the Police Departments
protection of Drug Operations on the Island, as I have identified with
photographic and official police documentation, the Hawaii County Police
Departments apparent involvement by providing official police protection
for organized drug operations in Puna and the apparent cover up of the
operations. The organized extorting actions against my person by
government officials in violation of HRS 707 -764 Extortion, which are
criminal violations of the Federal RICO Act as identified under 18 USC
1961, Racketeering activity, extortion, and dealing in a controlled
substance. The actions of the Police Dept. identifies a pattern and history
of such activities. You, Det. Briski, DEA Agents Jesse, all Hawaii County
Council members, and other Federal agencies have been provided
pictures and verifying documentation and evidence of the
apparent organized drug operations, either directly or electronically with
no apparent enforcement action having been pursued. At a 19 Aug
2009 drug scene I witnessed Officer Sojot call you on his personal cell
phone, apparently to get instructions after which the Hawaii County
Police Dept. violated my State and Federal rights and continue to illegally
retained me for an unauthorized and illegal blood test to remove me from

the scene so the police dept could apparently cover up evidence of the
drug operations. During the Aug 19, incident in HPP where police
received a 911 call about drugs involvement in a traffic incident
involving an apparent Drug Mule riding an illegal motorcycle struck a car
and the drugs and packets of $100 bills were spread over the scene,
supporting photographic evidence was available to the Officers called to
the drug scene, but the two officers refused to look at the evidence or
take my statement about the drugs and money I saw and
photographed, but upon recognition of the apparent Drug Mule and
surrounding persons immediately call in on their Police Radio and
reported that no drugs involved and left the scene.
I am aware that the Hawaii County Police Department has applied for
CALEA certification, your non response to this notification of possible
organized drug operations in the Hawaiian Paradise Park area will be
construed as confirmation of the aforementioned allegations and will be
reported to Ms. Mitchell the CALEA Representative overseeing the Hawaii
County Police Departments accreditation process.
Thank you for your attention in this matter of the Public Safety,
Health, and welfare.

Every person who, under
color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or
the District of Columbia, subjects, or causes to be subjected, any citizen of the United
States or other person within the jurisdiction thereof to the deprivation of any rights,
privileges, or immunities secured by the Constitution and laws, shall be liable to the party
injured in an action at law, suit in equity, or other proper proceeding for redress, except
that in any action brought against a judicial officer for an act or omission taken in such
officer's judicial capacity, injunctive relief shall not be granted unless a declaratory decree
was violated or declaratory relief was unavailable. For the purposes of this section, any Act
of Congress applicable exclusively to the District of Columbia shall be considered to be a
statute of the District of Columbia.

device has been used once,

When an officer uses a
stun gun, he must immedi-
ately notify his supervisor
and file a report, Kealoha
said. That report is submit-
ted to the police chief and
the Special Response Team
lieutenant, who is respon-
sible for training related to
the department's use of the
weapon, he said.
Using the device in a
manner inconsistent with
police policies can result in
discipline, Kealoha said.
The other lawsuit, filed
by Seitz in January on behalf
of Russell Doi, claims that
Officers Jo Aoki and Ryan
Pagan violated Doi's consti-
tutional rights when arrest-
ing him following a dispute
between siblings regarding
Power of attorney over their
father, according to the law-
suit.
According to the suit,
Doi returned home with his
father on Oct. 8, 2009, to
find police and his siblings
at the home. After present-
ing the officers with power-
of- attorney paperwork, Doi
moved to one side of his
car to see if his father was
still inside. Aoki allegedly
pushed Doi, causing him to
fall on a vehicle and cut his
left forearm.
When Doi "bounced off
the vehicle," Aoki allegedly
put Doi in a headlock and
twisted Doi's neck. When
Aoki saw Doi was bleed-
ing, he released him and
Doi went inside the home,
according to the suit.
Later, Doi came back
outside and began yelling
and questioning his siblings.
The officers ordered Doi to
the ground, where he was
handcuffed and arrested for
disorderly conduct. He was
later released on bail and
the charges against him
were dropped, according to
the suit.
Police Chief Harry Kubo-
jiri is also named in the
lawsuit because he alleg-
edly "failed and/or refused
to properly train, supervise,
and/or discipline police offi-
cers under (his) supervision
and control thereby proxi-
mately and directly causing
the injuries" to Doi, accord-
ing to the suit.

Subject: Federal Court Civil Rights Law Suits against the Hawaii County Police Department
Aloha Hawaii County Council Members,
In light of the current law suits filed in the U.S. District Court, District of Hawaii,
recommend that you obtain, and consult, competent Legal Counsel to advise you on
your personal civil and criminal exposure under the Federal RICO laws for your
failure or neglect to prevent deprivation of civil rights as guaranteed to all
people within the United States and State of Hawaii by the Constitutions of the State
of Hawaii and the United States of America, as to your actions as an accessory after
the fact to Deprivation of Rights under the Color of Law and Conspiracy against
Rights identified by your involvement in silence and non - action to racketeering
activities in the governments of the County and State of Hawaii.
There are over 60,000 pages on file and in State and Federal Court records, the
Hawaii County Clerks Repository of Records, Hawaii State Senate and House along
with U.S. Senate and U.S. House that are accessible on the Internet, or available by a
mere request to me by Counsel for the Plaintiffs for copies. A portion of this
documentation and evidence identifies the involvement of the Hawaii County
Council, body politic, and individual Council Members that is uncontested as to
allegations of your participating in racketeering activities in support of a RICO
Enterprise that influences, controls, or extorts County, State and Federal offices and
employees in the State of Hawaii, to include Judges and Officers of the Courts of the
State and Federal Court systems in Hawaii that you have admitted to in an indirect
confession under the Doctrine of Assenting- Silence as being truthful and accurate.
Can you imagine the cost to the County of Hawaii for lawyers to review all this
documented evidence? Where is the County of Hawaii going to get the money,
another Bond Offer of County General Obligation Bonds where the County will have
to endure scrutiny by Bond Rating Agencies as required by the Securities Act of
1933, Section 17(a)(2)?

Assenting - Silence when you failed to respond, or to dispute these allegations of your
now confessed criminal actions in support of racketeering activities by the Hawaii
County Police Department and others where you failed to contest or protest such
allegations by the 15 February 2011 deadline.
Would you like another Bite at the Apple and respond as to any defense of you
non - actions committed under your Sworn Oath of Office as neglect to prevent civil
rights violations of the people in light of the front page article in today's Hawaii
Tribune - Herald, "County to pay police officers' court costs ", I will give you until
Tuesday, 1 March, 2011 if you can offer any defense of you actions, or non - actions as
Sworn Elected Public Officials and a Civil Authority under the United States.
As always a non - response to the above will be identified as yet another indirect
confession on your part as to confessed violations of your Sworn Oath of Office and
accessory after the fact to known criminal RICO activity in accordance with the Legal
Doctrine of Assenting -in- Silence as to your guilt in these matters and will used in
future civil torts in State and Federal Courts, in addition to being made available to
the Plaintiffs in the current U.S.Dictrict Court actions against the County of Hawaii
as supporting evidence as to patterns and histories of Police Abuse.

Aloha Ms. Mitchell:
As per our past conversations I am forwarding you verifiable
information about the involvement of the Hawaii County Police
Department in violations of Federal RICO laws and their history and
patterns of racketeering activities that include Extortion, RE: Hawaii
Revised Statutes HRS 707 -764, and Dealing in a Controlled Substance,
RE: 18 USC 1961 as defined in section 102 of the Controlled Substance
Act.
At approximately 3:OOPM, 1 Nov 2010, as per statements from the
Court Bench by State Circuit Court Judge Glenn Hara, that he was sure
and agreed that the Hawaii County Counsel, and Hawaii County
Government, Defendants, had committed violations of law in regards to
their actions in preventing the public access, or informing the public,
about government records identifying an imminent peril to public safety,
health or welfare by the County's action to defraud the United States by
using Federal Emergency and Disaster monies to alter stream beds in the
Hilo, Hawaii areas for the benefit of politically, or
Culturally/ Ethnically privileged persons for land and/or property
development in areas that should have been identified as FEMA Flood
Zone A thereby preventing building and development. Federal
Emergency monies were corruptly used by the County of Hawaii in
authorizing and supervising the constructing of non - permitted and non -
documented Stream Diversion Works from over 4,000 cubic yards of
flood debris material in 2001, resulting in 1O's of millions of dollars of
flood damage in 2008 to properties down stream, and fraudulently and
corruptly revising FEMA FIRM's so the areas in question are identified as
FEMA Flood Zone X, allowing the properties and lands development. It is
noted that a number of Hawaii County Police Officers live in the areas of
Hilo, Hawaii identified under the fraudulent and corrupt FEMA FIRM'S
and exposure of the organized government corruption and racketeering
activities could result in a revision of FEMA Flood Maps with devastating
effects on property values, property insurance, or ability to sell or

transfer properties due to inability to obtain Title insurance due to Flood
Zone designations.
I attempted to file a Complaint with the Hawaii County Police
Department for Extortion against my person by a number of elected and
appointed government officials engaged in a pattern and history of
violations the the RICO Act by an Enterprise of corrupt government
officials for the purpose of defrauding the governments of the United
States and the County of Hawaii, and to present to the
Federal Emergency Management Agency, FEMA, fraudulent and corrupt
FEMA FIRMs, (Flood Insurance Rate Maps). Police Officer C. Kekela took
my statement and I presented her a 1 inch thick correlated copy of
government records to support my filing of the complaint of Extortion
and organized racketeering activities by the Hawaii County Council,
Hawaii County Corporation Counsel, Hawaii County County Prosecutors
Office, Hawaii County Mayors Office, Police Department, and organized
government officials, to include the current and past Hawaii County
Police Chiefs. Officer C. Kekela consulted with her Desk Sergent D.
Tolentino to get a Police Report Number for the Complaint and was
instructed by her Desk Sergeant to refuse to except the complaint, not
even a Miscellaneous Service Sheet was generated to my knowledge, and
I was told by Officer Kekela that I had to go to the State Attorney
General, they did not have any idea who to contact or procedures to file
such a Complaint, but Officer Kekela had information that the State
Attorney Generals office was involved in organized corruption due to
"Local" Cultural and Ethnic bonds.
I tape recorded the statements of Hawaii County Police Officer C.
Kekela and will provide them to CALEA, Please notice that I have also
sent directly and Cc'd the Hawaii County Police Chief and others, I
challenge any of the addresses of this email to provide verifiable evidence
disputing the information contained in this Email, or on file in the
Circuit Court of the 3rd. Circuit, State of Hawaii, Case No. Civ 10 -1 -82
as filed with the Court as required by United States Criminal Code 18
USC 4 Misprision of Felony.
Thank you for CALEA's attention in this matter, and I encourage your
organization to deny accreditation to the Hawaii County Police
Department and turn over evidence obtained in the accreditation process
to the U.S Department of Justice, Criminal Division, Public Integrity
Section.

Aloha Mayor Kenoi, U.S.Attorney Kubo, & Det. Briski.
I have provided the Hawaii County Police Department Internal Affairs section, Det.
Briski, extensive information and evidence identifying wide spread violations of the State and
Federal RICO statutes, with the personal involvement of the former and current Police Chief,
Corporation Counsel, Prosecuting Attorney's Office, Mayor's office and other public office's. A
traffic incident in Puna on the night of Thursday, 20 Aug 09 involving an apparent drug dealer
has provided prima facia evidence of the Police Departments involvement in the official
protection of organized drug activity in the Puna District of the Island of Hawaii. Please note
that the officer that arrived first on the scene called headquarters at my demand to inform the
Police Chief of my involvement in the incident where it was clearly apparent the three officers
on site were aware that I had photographic evidence to support my 911 call about the incident
and that there were drugs involved. The two Officers that arrived latter for the drug
investigation did not even bother to take a statement from me but seemed to recognize
the the parties present and called in that no drugs were present. The digital photographs
could have been made available to the Officers in a 8X10 inch color printed photo or view in
magnification within five,(5), minutes as my computer was just a few hundred yards away.
Such photographs would have been more than sufficient for a probable cause search and
questioning of witness about drug activity. It appears that a local male was delivering a large
quantity of drugs while riding a camouflaged trails bike and entered the street from the bushes
and struck the front of my truck scattering bundles of money into the street, what appeared to
be bundles of $100 bills as in the photo provided to Det. Briski, and attached hereto. This
photograph was taken at the moment that the guy had finished scrambling to grab the money
in the street and had just turned over and was before anyone had gotten to him, and is
apparently a split second before he threw the drugs into the bushes behind him.You will notice
that if you enlarge the photo and look at the off white item the size of a roll of quarters
wrapped in a plastic baggie with a white write on label in the guy's right fist, there can be
little doubt that this is an ounce of drugs, which the guy apparently threw into the bushes
behind him. This observation is supported by the fact that an area of fifty feet radius around
where this guy was laying was trampled in an apparent search the following day /night, but not

a search by law enforcement authorities. It would appear that the witness the officer spoke to
and /or took statements from may have been involved in the current drug activity or had
knowledge of it.
I have additional photographic evidence in support and am very puzzled as to why the
Hawaii County Police department is making it extremely difficult for me to present the
evidence of organized drug activity here in the Puna district,where it appears that at least 5
ounces may have been involved but probably more, as construed by the drugs and money
observed. If the Police are not involved in providing protection for drug operations why is it
that there appears to be no interest by police about the information as to the apparent
Hispanic gang member sighted in the area the next morning?
The Police Department has received numerous calls about drug activity in the Puna and
HPP area, but appear to take no enforcement action, but allow the public to be extorted by
the Police by the Police allowing predator trucks raised high in the air with over -sized tries,
blacken windows, loud boom box bass stereos and headlights high in the air that blind other
traffic on the highways, and appear to be driven by what are called "Locals ", that seem to
operate on the highways with immunity giving the impression that the Hawaii County Police
Department enforces laws on who they what to, when they want to, and if they want to, but
not on this privileged group that resembles the public's perceived view of the drug dealers
themselves.
Please contact me for supporting documentation of organized corruption within the Hawaii
County Police Department and in other government offices in the County of Hawaii.

Thank you for your concern, but it was no accident. I understand that you did not share
the information about the drug activity and the Police Officers conduct at the scene I
presented to you in your official position within the internal affairs division of the Hawaii
County Police Department, and the Officer that is investigating the traffic incident has not
contacted me for the data CD, pictures, and other documentation as he asked me if I had
pictures of the money after interviewing the individual that ran into the front of my truck while
he was being treated for injuries in the emergency room of the Hilo Hospital. As per my visit to
the Keaau station around 1400 hrs on the 21 Aug, where I showed the pictures and
information to the office secretary where the secretary recognized the individual with the
money and drugs as she lives in this area and stated that she also has had some close traffic
encounters with this individual, she took an extensive note to pass to the investigating Officer
who was off until Monday. I have not been contacted about the information however at 0820
hrs this morning a nine passenger State prison van followed by a car with a uniformed State
Sheriff passed in front of my location and turned toward the ocean at the intersection of 26th
and Kaloli with an ambulance parked a few hundred yards down the street as if in standby,
any ideas what was going on?
As far as calling the Ice Task Force, the ambulance this morning was parked in front of a
location that is well known to the VICE and Narcotics divisions of the Hawaii County Police, I
have pictures, why has the Hawaii County Police Department contacted this "Ice Task Force "?
About for your recommendation to contact the "Hawaii Police Commission ", with the
evidence you have I can only understand your statement to be a cruel joke, the last time I
presented the Hawaii Police Commission evidence of corruption in the Police Department was
in the presents of your current Police Chief and the verifiable evidence I served upon the
Commission Chair, Pudding Lasister, was turned over to Lincoln S.T. Ashida and it
disappeared. You will please note that Lincoln S.T. Ashida has committed numerous knowing
and knowingly acts and actions of extortion and blackmail, including Extortion and
Blackmail against my person in Public testimony before the Hawaii County Board of Ethics as
documented in the minutes of the Board's 10 June 09 meeting. The Hawaii County Police
Department refusing to take any action as is evidenced by your signature on a complaint I
filed with the Hawaii County Police Department, and the previous attempts to bring to the
attention of law enforcement authorities, and judges of Courts of the United States.
It would appear by your actions, or lack of actions as required by your Oath of Office, and
Hawaii County Police Department General Order #600, that you may be part of the problem,

do you see any reason that I should not take legal action against yourself and other Public and
Police Officials in the form of a personal tort in U.S. District Court for neglect to prevent as
codified in the United States Code so that all the evidence of corruption will become publicly
available in U.S. Court Records for all to see? Are you part of the problem or are part of the
solution? I truly hope that you are working with Federal authorities in these actions as I find
you to be a sincere individual put in a very delicate position, but you swore an oath.
Again thank you for your concern as to my well being after I was hit by that drug runner.

Here is a picture of the Officer that first arrived on the scene, and the guy in the blue
shorts talking to him was the person that arrived moments after the drug runner hit me, it
appeared to me that this guy was a spotter or had some knowledge of the drug actvity going
down. The first vehical to stop was the same truck that the camouflaged trail bike was
loaded, extremely rapidly, into by the guy in the blue shorts talking to the officer, by him
physically picking up the motorcycle and putting it into the back of the truck with plates EFB-
315 the second the officer released the scene, and he seemed very much more interested in
the bike than in his injured friend.
This Officer said he knew you and would contact you to confirm information about police
corruption I presented to him.

As per our phone conversation this date I am sending you photographs of the drugs and
money that was reported in the 20 Aug 09, 1900 hrs, 911 call, how did Hawaii's finest miss
this, and why did the two officers sent to investigate drugs not even bother to ask for my
statement or the pictures that everyone on site knew I had taken? Please note that the next
day a fifty foot area around when the guy with the drugs in his right fist was laying was
trampled down, I also have before and after pictures documenting this. I understand the guy
was issued a ticket at the hospital for operating with a suspended license, again why did no
officer want to know about the evidence I had and what I saw, and it appeared to me that
almost as soon as the latter two officers arrived they seem to recognize the people and called
in that there were no drugs.
At current street value wouldn't the drugs in his hand, about the size of a roll of quarters
represent and ounce with street value of $5,000 - $6,800 according to newspaper reports, and
with 4 -5 bundles of $100 bill about 1/2 inch thick would represent about $5,000 each bundle.
I have many more pictures and license plate numbers of the people who suddenly appeared
as witness and as I was yelling and pointing "Look at the money the guy is running drugs ", a
guy in blue shorts, I have pictures, told me that is not drug money he just sold a refrigerator
to his sister? The trails motorcycle is painted camouflage and this guy was coming out of the
grass at night on the side of the road next to the house with 6 mongrel dogs tied around the
perimeter of the house, the same house that the police officer took a witness statement from,
and is the same house that I observed the next morning, 21 Aug about 0800 the short thin
shirtless Hispanic looking guy with a well developed upper body covered with apparent
Mexican gang and prison tattoos in front of same house across the street from where the drug
runner ran into my truck, and apparently thew the drugs in the picture into the bushes behind
him. Again how did the police miss this, and why did they deliberately avoid getting my
statement.
